 International non-governmental organization founded in 1979 (International Year of the Child)  Forefront in drafting and lobbying for the UN Convention on the Rights of the Child (UN CRC) and also other UN standards in the field of Juvenile justice (the Havana Rules)  DCI is an international movement with over forty-five national sections worldwide  Priority area: Justice for Children

Why a Global Study An unknown number of children are deprived of their liberty worldwide We know very little about them They are mainly forgotten and invisible Deprivation of liberty in different settings (justice system, penal system, health institutions, immigration, care,…)

A Global Study Collect data & statistics on the number and situation of children in detention worldwide Include all* forms of deprivation of Liberty Practices & recommendations (promote alternatives/non-custodial measures) Clarification of relevant concepts

Children Deprived of Liberty “Deprivation of liberty means any form of detention or imprisonment or the placement of a person under the age of 18 in a public or private custodial setting, from which this person is not permitted to leave at will, by order of any judicial, administrative or other public authority” -United Nations Rules for the Protection of Juveniles Deprived of their Liberty (Havana Rules 1990)  Estimated 1,000,000 children are incarcerated in the criminal justice systems worldwide.  75% on pre-trial detention  60% for petty offences But how many in health care, migrants detention centres,…?

UN Convention on the Rights of the Child Article 37, Convention on the Rights of the Child States Parties shall ensure that: (a) No child shall be subjected to torture or other cruel, inhuman or degrading treatment or punishment. Neither capital punishment nor life imprisonment without possibility of release shall be imposed for offences committed by persons below eighteen years of age; (b) No child shall be deprived of his or her liberty unlawfully or arbitrarily. The arrest, detention or imprisonment of a child shall be in conformity with the law and shall be used only as a measure of last resort and for the shortest appropriate period of time ;

UN Convention on the Rights of the Child (c) Every child deprived of liberty shall be treated with humanity and respect for the inherent dignity of the human person, and in a manner which takes into account the needs of persons of his or her age. In particular, every child deprived of liberty shall be separated from adults unless it is considered in the child's best interest not to do so and shall have the right to maintain contact with his or her family through correspondence and visits, save in exceptional circumstances; (d) Every child deprived of his or her liberty shall have the right to prompt access to legal and other appropriate assistance, as well as the right to challenge the legality of the deprivation of his or her liberty before a court or other competent, independent and impartial authority, and to a prompt decision on any such action.

THE RESOLUTION! (d)To invite the Secretary-General to commission an in-depth global study on children deprived of liberty, funded through voluntary contributions and conducted in close cooperation with relevant United Nations agencies and offices, including but not limited to the United Nations Office on Drugs and Crime, the Office of the United Nations High Commissioner for Human Rights, the United Nations Children’s Fund, the Office of the Special Representative of the Secretary-General for Children and Armed Conflict and the Office of the Special Representative of the Secretary-General on Violence against Children, as well as the Interagency Panel on Juvenile Justice, and in consultation with relevant stakeholders, including Member States, civil society, academia and children, and to include good practices and recommendations for action to effectively realize all relevant rights of the child, in particular those supporting the implementation of the United Nations Model Strategies and Practical Measures on the Elimination of Violence against Children in the Field of Crime Prevention and Criminal Justice, and invites the Secretary-General to submit the conclusions of the study to the General Assembly at its seventy-second session;
