Clean Water Act (CWA) of 1972  Regulates discharges of pollutants into the waters of the United States  Regulates quality standards for surface waters Environmental Protection Agency (EPA)  Responsible for enforcement of/compliance with the CWA  Responsible for setting water quality standards  Requires Municipal Separate Storm Sewer System (MS4) permits for stormwater discharges Chesapeake Bay TMDL  EPA Mandated “Pollution Diet”

Chesapeake Bay TMDL  TMDL...Total Maximum Daily Load...the amount of a pollutant that a waterbody can assimilate without violating water quality standards  Nitrogen, Phosphorus, and Sediment are the pollutants that must be reduced  Urban Stormwater, Wastewater, Agriculture, and Septic Systems are affected sectors  % of actions should be completed  all control measures should be in place

Virginia Department of Conservation and Recreation (DCR)  Develops plans of behalf of Virginia localities to meet EPA requirements  Administers Virginia Pollutant Discharge Elimination System (VPDES) General permit which includes Williamsburg’s MS4 permit  Prepared Phase I Watershed Implementation Plan (WIP) for EPA approval December 2010  Phase I WIP detailed how and when Virginia will meet the pollution allocations set by EPA  Final Phase II WIP will be submitted to EPA by March 30, 2012  Phase II WIP will direct localities how to reduce pollutants to meet the ChesBay TMDL

Hampton Roads Planning District Commission (HRPDC)  Assists Hampton Roads localities with stormwater regulations  Developed a Regional report documenting efforts of localities in development of the Phase II WIP  Developed a Regional Water Quality Management Scenario to meet the Phase II WIP  The HRPDC report recommends that the state provide funding to assist the localities in meeting the TMDL  The report also recommends expansion of the Chesapeake Bay Preservation Act to include all localities that are in the Bay watershed

What’s Next?  Await feedback from EPA/DCR on Phase II WIP  MS4 Permit renewal by July 1, 2013  ChesBay TMDL Implementation Plan will be formalized and included in the renewed permit  City’s SWM Ordinance and Plan revisions to new Virginia Regulations by July 1, 2014  Costs...To be determined based on additional level of effort required
