Lesson Objectives  Verify company’s compliance with drug testing rules  Evaluate passenger safety orientation briefs  Evaluate vessel operators’ emergency instructions  Evaluate maintenance & inspection records for lifesaving equipment PQS Tasks Covered: GH02, GH03, ED03

Drug Testing Rules Employers are required to implement a chemical testing program for dangerous drugs. These include the following:  Marijuana  Cocaine  Amphetamines  Phencycladine (PCP)  Opiates If an employee tests positive, he/she must be removed from “safety sensitive positions” aboard the vessel.

Drug Testing Rules Pre-employment Chemical Test  Pre-employment chemical test for “Dangerous Drugs”;  results must be received before boatman/crewman can begin working on the boats;  Test performed must be DOT test

Drug Testing Rules Random Testing  Once the pre-employment test is passed and person is hired (or re-hired), he/she must be part of a random testing pool.  At least 50% of a pool must be randomly tested annually.  Tests must be random. Employees have an equal chance of being selected at each testing interval.  Tests must be unannounced & evenly spread out.

Drug Testing Rules Reasonable Cause Testing  When the employer suspects that an employee is using a dangerous drug  Suspicion must be based on reasonable and articulable belief that the individual has used a dangerous drug.  Must be based on direct observation of specific behavioral and performance indicators.

Drug Testing Rules Post Casualty Dangerous Drug and Alcohol Testing must be done when an accident results in: Loss of an inspected vessel When total damage exceeds, or is expected to exceed $100,000. When a crewmember, passenger, or other person (not necessarily on the vessel) is hurt “beyond first aid” Any accident resulting in one or more deaths

Drug Testing Rules Operating Under the Influence of alcohol or a dangerous drug  If BAC is 0.04% or more (for commercial operators, unless state has established different level for commercial operators)  “If the individual is operating any vessel and the effect of the intoxicant(s) consumed by the individual on the person’s manner, disposition, speech, muscular movement, general appearance or behavior is apparent by observation

Drug Testing Rules Employee Assistance Training:  Training for all boatmen: “Awareness” level.  Operator can develop own training agenda or use commercial service (video, on-line tutorials) available for a fee). One example: ork.com/training- brochure.pdf

Drug Testing Rules Pretty complicated, eh? Options: 1. Form a consortium of area operators, then establish a relationship with local testing facilities who are able to do DOT drug testing 2. Enroll in a Consortium: Private companies that manage some or all aspects of an operator’s drug testing program.

Passenger Orientation Person in charge of the boat must ensure: Passengers know how to don their lifejackets Know where the lifering or throwable flotation device is & how to use it How to embark & disembark the vessel What to do in case of fire, flooding or man overboard

Passenger Orientation Person in charge of the boat must be provided with simple Emergency procedures checklist for fire flooding/capsizing/loss of buoyancy Man overboard Emergency procedures checklist should be SIMPLE, and immediately available

Emergency Drills Motor rig operators must ensure that their crews conduct a sufficient number of drills to ensure that each crewmember is familiar with his or her duties. Make sure it gets documented!
