How can Direct Payments be used? Employing own staff Contracting with an agency or service provider Mix of Direct Payments and Trust Services Self-employed?

Who could be eligible for a Direct Payment? disabled people older people who get services from the Trust disabled parents parents of disabled children carers for services to meet their own needs Any of the following who, after an assessment of their needs by Social Services, qualify for social care provision -

Who Can Agree to Using a Direct Payment - assessed as needing personal social services - over 16 year olds - ‘willing and able’ to manage Direct Payments alone or with support NOTE : Those who lack capacity to consent to Direct Payments being all or part of their social care will receive support from their Trust to have an Authorized Person appointed through the OCP. This currently has financial implications for families, but can be appealed. - not subject to certain mental health or criminal justice legislation

What is Self-Directed Support? Self-Directed Support is a change in the way social care systems operate to give an individual choice, control and power over the support they receive.

Direct Payments and Self-Directed Support (SDS) Both:- based on Social Model of Disability - take a person centred approach - place the principles of Independent Living at the core of Social Care (focus on choice, control & flexibility) SDS builds on the basis of existing Directs Payments system SDS uses terms Personal Budget and Individual Budget

Types of Budgets – Where does the money come from? A Direct Payment = An amount of money from local Health and Social Care Trust. A Personal Budget = The total amount of money a local Health and Social Care Trust uses to provide support to an individual service user. An Individual Budget = Money from local Health and Social Care Trust PLUS money from the Independent Living Fund, State welfare benefits and personal resources available to spend on social care provision.

What is Personalisation? “The process by which state provided services can be adapted to suit you. In social care that means everyone having choice and control over the shape of their support along with a greater emphasis on prevention and early intervention” Department of Health 2009

WHAT CAN MONEY BE SPENT ON? Underpinning principles: Personal budgets must uphold Trust values and be free at the point of delivery and not depend on ability to pay They must support safeguarding and quality They must support the tackling of inequalities and protecting equality They must be voluntary (!) They must support the making of decisions as close to the person as possible They must support partnership working

WHAT CAN’T MONEY BE SPENT ON? What is excluded? Emergency or acute services The majority of primary care services (including visits and assessments of GPs) Anything illegal Gambling Debt repayment Tobacco Alcohol

How do people access Direct Payments and Self-Directed Support? Service users or their representatives should speak to their Social Worker, Care Manager, CPN, Learning Disability Nurse or local CILNI Adviser. Trust staff should know about Direct Payments, but might still need to learn more about SDS (apart from SHSCT).

How Can CILNI Help? Assist with support planning Identifying useful types of support available Recruiting staff Give advice and provide ongoing support to those who choose to directly employer their own staff (Personal Assistants) Assist with managing your payroll and advise on any HMRC requirements (Payroll Service)
