What are the Implementation Procedures (IPs) Procedures to Implement the Texas Surface Water Quality Standards (IPs) RG-194 A guidance document that explains how theTCEQ applies the Texas Surface Water Quality Standards

IP Revision Process Triennial review process 2010 IPs approved at the June 30, 2010 TCEQ Commissioner’s Agenda EPA approved most of the 2010 IPs on July 12, 2013 Next water quality standards revision: 2017 Next IPs revision also targeting 2017 completion date

Unresolved EPA Objections to the 2010 IPs Dechlorination Variances Whole Effluent Toxicity- Reasonable Potential Determination

Focus of the 2017 Revision Reasonable Potential for WET Testing Dechlorination Variances Temperature 7Q2 and HM segment flow data Ambient segment WQ data 316(b) Rule Implementation Endangered species MALs pH screening procedures Correcting errors/omissions in current IPs

Dechlorination (possibility) 2010 IP Proposed Requirements for renewing, new, and expanding domestic discharges with design flows between 0.5 and 1.0 MGD 2017 IP Proposal Phase I and Phase II Approach Phase I – New and Amended Phase II - Renewals

Variances Adopting a standard for local conditions requiring EPA approval and opportunity for public hearing. EPA Objection – no compliance date (specific) for meeting final effluent limitations.

Temperature Stakeholder meetings began in August of 2014 TCEQ is taking initial comments and working on a detailed procedure to include in the 2017 IP Draft procedures are proposed to be presented to stakeholders in Summer 2016.

Critical Conditions 7Q2 and Harmonic Mean Flows Calculated for each classified segment Analyzed using 29 years as the period of record where data is available Data has to be verified and released before it can be used, it is otherwise considered provisional. Located in Appendix C of the 2010 IPs. Critical condition reviewers are Jeff Borski and Nancy Vignali

Ambient Water Quality Data Located in Appendix D of the 2010 IPs Data given for individual segments Routine water quality data is analyzed to derive segment-specific values TSS, pH, hardness, TDS, chloride, sulfate

316(b) Intake Structures Updates Final rule effective October 14, 2014 Stakeholder meetings are being held. Most recent meeting April 14, TCEQ working on updating TPDES application worksheets to include 316(b) information. Working with EPA and permittees on rule implementation issues and requirements. Contacts for 316(b) are Merrit McKelvy, Kara Denny, Brittany Lee (biological requirements)

Endangered Species  New Listings  Smalleye shiner  Sharpnose Shiner De-listing Concho water snake Located in Appendix B of the 2010 IPs

Minimum Analytical Levels (MALs) and Suggested Analytical Methods  Located in Appendix E of the 2010 IP.  Updates are being done as necessary to the MAL as well as the suggested method if necessary.  Examples of what is being done: The MAL for Toxaphene is 0.3 ug/L in Table E-1 and 1.0 in Table E-2. This inconsistency will need to be resolved. Trichlorfon is misspelled in Table E-1.

pH Screening Procedures Screening procedure established with EPA concurrence for certain direct discharges to classified segments pH Screening conducted: for major municipal facilities (≥1 MGD flow) for industrial discharges

Summary of Proposed Revisions Dechlorination Variances Temperature – cooling water Updates to Segment flow data Update Segment ambient WQ data 316(b) rule implementation Endangered species MALs pH Screening procedures General updates and corrections
