8 Texas is a Delegated NPDES State
EPA and TCEQ entered into an MOA that establishes responsibilities and expectations for TPDES permitting under the CWA EPA delegated the NPDES program to TCEQ in 1998 EPA retains oversight and ultimate authority EPA delegated the NPDES program to TCEQ in 1998. 9 WQD: Permits Texas Pollutant Discharge Elimination System (TPDES) Permits Issued to facilities that discharge directly to surface water. Texas Land Application Permit (TLAP) Authorizes the disposal of wastewater by evaporation, irrigation, and/or land application of sludge. Pie chart – Stormwater permits account for approximately 90% of the TPDES permits Pie chart – Municipal wastewater accounts for approximately 65% of the TLAP permits

Site-specific and technical review of the regulated activity General Permits One state-wide permit for similar types of activities; operate under terms and conditions of the general permit Pie chart for individual permits- Municipal wastewater permits account for approximately 65% of the permits and Industrial wastewater permits account for approximately 15%. Pie chart - General permit authorizations account for approximately 90% of the permits and authorizations issued by the Water Quality Division.

16 HB 1902 Graywater and Alternative Onsite Water
The bill creates a new regulatory program that allows the reuse of alternative onsite water which the bill defines as: rainwater, air-conditioning condensate, foundation drain water, storm water, cooling tower blowdown, swimming pool backwash and drain water, reverse osmosis reject water, or any other source of water considered appropriate by the commission."

The bill requires TCEQ to develop minimum standards for the use of treated graywater and alternative onsite water The standards must: Allow the use of graywater and alternative onsite water for toilet and urinal flushing; Establish minimum treatment requirements *Commissioners Agenda for proposal July 6, 2016 Comment Period ended March 1, 2016. 18 HB 2031 Desalination Projects
The bill requires an expedited permitting process for discharge permits for treated marine seawater and waste from desalination marine seawater into the Gulf of Mexico Discharges into the Gulf within 3 miles offshore requires: Public notice, public comment, opportunity for public meeting, and opportunity for contested case hearing

20 Rule Petition Beneficial Reuse of Treated Effluent
Petition to amend 30 TAC Chapters 222 and 309, regarding the use of treated wastewater for subsurface irrigation and land application A permittee would demonstrate a “firm reclaimed water demand” to show they have an alternative use for their treated wastewater. *Commissioners Agenda on May 11, 2016 Agenda backup materials are currently available.
