Legislative Background Regulation 178/2002 Articles 14, 15, 17 (1), 18, 19 & 20 Lays down general principles and requirements of food law, established European Food Safety Authority Lays down procedures in matters of food safety 4

Articles 14, 15, 17(1), 18, 19 and 20 of 178/2002 apply for Cross Compliance Must make sure that the food and feed safety requirements, as laid out in Articles 14 and 15 of Regulation 178/2002, are met Must ensure that relevant food and feed safety requirements of food law are met at all stages of production, processing, distribution within the businesses Legal Basis 5

Legal Must maintain traceability systems. Must withdraw and/or recall food or feed from the market if this is not in compliance with food or feed safety requirements, and notify competent authorities 6

SMR 4 Increasing emphasis on: Continuing importance of hygiene in the food industry Delayed herd testing will be sanctioned Maintenance of Animal Remedies Records Particular emphasis on the dairy side 7

Application This SMR applies to farmers in their capacity as food and feed business operators producing food or feed from plants or rearing animals for food or producing products of animal origin. 8

Section 1 Feed Business Operators Is there evidence that feed additives and veterinary medicinal products are not used correctly Is there evidence that feed is not transported stored and fed so as to avoid hazardous contamination including from chemicals and other products prohibited for animal feed 11

Is there evidence that medicated and non- medicated feeds are not stored and or handled in such a manner as to prevent contamination and avoid feeding to non- target animals Is there evidence that feed has been sourced and used from establishments which are not registered based on a check of farm records Feed Business Operators

Is there evidence that the necessary records in respect of feed hygiene are not being maintained 13

Is there evidence that the dairy/milking parlour or equipment are not kept clean and in good repair Is there evidence of inadequate separation of the dairy from sources of contamination Is there evidence that internal surfaces that are intended to come in contact with milk are dirty Is the milk tank incapable of cooling milk to 8C if collected daily or to 6C if collected every 2nd day or longer Section 2 Dairy/Milking Parlour 14

Are good hygiene practices used ?

Section 3 Cow Housing Is there evidence that cow housing, yards and passageways are constructed and or managed in such a way that cows are dirty. 16

Section 4 Hygiene During Milking Is milk from diseased animals entering the food chain Is there evidence that the isolation of infected animals or animals suspected of being infected is not effective Is there evidence that the milking animals are not in a good general state of health Is there evidence that before milking starts teats udders and adjacent parts are dirty 17

Are withdrawal periods observed?

Section 4 Hygiene During Milking Is there evidence of the use of unauthorised or illegal substances Is there evidence that milk from animals with clinical signs of udder disease is not excluded from human consumption Is there evidence that withdrawal periods have not been observed in the case of the use of authorised products or substances requiring milk withholding periods Is there evidence that animals undergoing a treatment likely to transfer residues to milk are not clearly identified and that milk from these animals is not excluded from human consumption 20

Section 5 Eggs produced for sale  Is there evidence that eggs produced for sale are not kept clean, dry, free from extraneous odour and out of direct sunshine 21

Section 6 General Food Requirements Is there evidence of inadequate controls to prevent the introduction and spread of contagious diseases transmissible to humans through food Is there evidence that plant protection products and biocides are not used correctly Is there evidence that the applicant has not taken remedial action when informed of problems during official controls 22

Section 6 General Food Requirements Is there evidence that the applicant has failed to implement any requirements imposed as a result of any relevant analysis carried out on samples Is there evidence that the necessary records in respect of food hygiene including animals under treatment are not being maintained Is there evidence of inadequate control of vermin on the farm Is there evidence that storage and handling of waste and hazardous substances are not adequate to prevent contamination of food 23
