Why is it good? It has good consequences People know what is in their own best interest People are different Governments are a bit shit People have “rights” Our laws embed certain principles about what you should be able to do Everyone is entitled to things

Why is it bad? Liberties conflict with each other; your choice impacts on someone else’s choice Sometimes the government is better positioned to understand your interests People make really stupid choices (or might not even be making the choices in reality!)

But can you actually change behaviour? Deterrent effect Physically restraining perpetrators from engaging in the act, i.e. prison Discourse effect

What if you can’t? It is bad that people go to jail You create a black market You might create discursive backlash e.g. laws restraining hate speech

3 Questions to answer in a liberty debate Do we want people to be making a particular choice? If we don’t, can the government stop them? To the extent that they can’t, what harms occur? (write these down, you’re about to debate about this)
