2 Introduction; The Sharia The Sharia is the Islamic legislative system, or jurisprudence or in other words The Islamic Laws. Following Islamic law is a logical necessity (God, His Justice, His Messenger, His book (Quraan), The day of judgment) Humans should do as God commands, for their benefit.

3 Are the Islamic resources easily understandable and clear now? The Arabic language arts; grammar, Etymology, Vocabulary, Eloquent and Metaphors. The remoteness in time from the legislative era. The language of Quraan and the narrations (HADEETH) is different from what is practiced now.

4 How to solve that historical problem? By establishing a science which derives the Islamic laws from its resources, and provides the authenticity of those laws with proper evidence, and removes the ambiguities surrounding the resources. This science is called Elm Ol Fiqh, or Science of Islamic Jurisprudence. This science defines the practical stance (AL MOWQIF AL AMALI) in Islamic legislative system (Sharia).

5 The science of Jurisprudence It is the science of deriving the Islamic law from its resources (Estimbaat Alhokm Alsharie) Determination of the practical stance is done in two ways: 1-By defining the HOKM, and that is done if the evidence exists (DALEEL) 2-By defining the practical responsibility (AL WAZHEEFA AMALIYA), and that is done by the procedural principles or practical principles (AL USOOL AL AMALIYA)

6 Definition of Elm Elusool While deriving the law or the practical stance from the resources, there are common principles and general procedures used in many of the procedures of deduction (Estimbaat), study of these unified or common elements is done by Elm Usool Al Fiqh or Principles of Islamic Jurisprudence.

7 Elm Usool Al Fiqh Is the science of the common elements that are used in the procedure of deriving the Islamic Law (Alhokm Al Shari). The study of common elements means; studying its usage, its authenticity and validation, its sources, and its implementation.

8 Examples of common elements 1-Prohibition of immersing the head in water while fasting. The answer is yes, Why? Yaqoob b. Shuayb narrated, that Imam Alsadiq (AS) said: Neither the one in a state of Ehraam nor the one who fasts should immerse his head in water.

9 Specific Elements (The Jurist studies them) Yaqoob b. Shuayb is trusted Imam Alsadiq (AS) is Proof of God his word is the word of the Prophet (S) state of Ehraam fasts should immerse his head in water.

10 Common Elements (The Jurist implements them) Narration of trusted is proof Should not Neither and nor The literal meaning is proof
