3 Context for HIE Policy Sandbox Discussion The Query Health Policy Sandbox was originally written under the assumption that EHRs, providers, and other clinical data sources would be the acting Data Sources. However, there may be situations in which a HIE plays the role of a data source. Does having a HIE act as a data source, rather than a provider organization have any implications on the Policy Sandbox? The current policy language is based on the patient-provider relationship, not a patient-HIE relationship or provider-HIE relationship. Does additional language or guidance need to be put in place? Or is the Policy Sandbox clear enough as it stands to encompass HIEs? Note: The Operations Workgroup will not be changing the Policy Sandbox, rather we will be creating extra guidelines (if needed) to be used when HIEs are a data source.

5 Policy #1 of the Policy Sandbox is the most affected by this stakeholder change: Policy #1: Disclosing Entity: Whether or not to run a particular query, and to release any results, will be under the control of the disclosing entity/data holder. Recommended Language: In the event that a disclosing entity is a health information exchange (HIE) rather than a provider, we recommend that the data use agreements that the HIE has with various provider entities reflect this provider accountability, as well as making clear the HIE’s corresponding privacy, security and confidentiality obligations for its own uses and disclosures.
