1 New Jersey Employee Residency Requirements S 1730 Signed into Law 5/17/2011

2 S1730 – State Employee Residency Requirement Effective 9/1/2011, all newly hired employees must reside in New Jersey. These employees will have one year to comply with this requirement. Any employee hired after 9/1/2011 who fails to comply with this requirement will be terminated, unless granted an exemption. Bill applies to all employees of the Executive, Legislative, and Judicial branches of government. The bill also includes independent authorities and State colleges.

3 Employees Hired Prior to 9/1/2011 “Grandfather” provision of this law states that a person who holds employment but does not have residency in New Jersey on the effective date of the law shall not be subject to the requirement. Current employees may not move out of state absent an exemption.

4 Employees Covered by S-1730 Full time employees Part time employees Unclassified employees Temporary employees

5 Who is Not Covered? Employees of Temporary Agencies under contract with New Jersey – provided that their salaries are paid by these private agencies.

6 Residency Monitoring Each Appointing Authority is responsible for monitoring compliance by its employees. S-1730 does not designate any particular agency as the enforcement authority for this law.

7 Exemption Requests A committee will be designated to review all requests for exemptions from this law. Committee consists of 5 members – 3 executive branch representatives, 1 Senate representative, and 1 assembly representative. This committee has not yet met. More information will be available at a later date.
