Des Moines (1969) ANSWER: The court ruled that the students were protected by their 1 st Amendment rights. The students were peacefully using their right by wearing the armbands as a symbolic protest. Tinker v. Des Moines – Students began to peacefully wear black armbands to protest the Vietnam War. These students were then suspended and Tinker filed a Lawsuit stating that their right to Freedom of Speech had been violated.

Ferguson – Supreme Court ruled that “separate” facilities for different races were constitutional as long as they were “equal.”

Board ruled that racial segregation violated the Equal Protection Clause of the 14 th amendment. It did not fully succeed in desegregating schools but it ruled “Separate but Equal” and segregation unconstitutional.
