3 Who Can File Sexual Harassment Against a School District or School Employee? Anyone who claims to be a victim of Sexual Harassment Ex: Employees Students Volunteers Parents or Other visitors to the school

4 What is Sexual Harassment? It is UNWELCOME Sexual Behavior that makes you uncomfortable 1.It must be unwelcome 2.It must be sexual in nature

5 Quid Pro Quo A Quid Prop Quo is when an individual in a position of authority offers a subordinate a benefit in exchange for a sexual favor.

6 Quid Pro Quo Examples A teacher may offer a student a better grade or a particular position on an athletic team in exchange for a kiss. A supervisor may offer an employee a higher evaluation or a promotion in exchange for accompanying the supervisor to dinner.

7 Hostile Environment A hostile environment is created when unwelcome advances, requests, or conduct have the effect of interfering with the performance of duties or creating an intimidating, hostile, or otherwise offensive work or learning environment.

8 Examples of Hostile Environment Asking a co-worker or student out on a date Giving a student an inappropriate card or flowers Hugs, massages, or other offensive touching Making telephone calls or sending inappropriate text messages

9 Conduct that can amount to Sexual Harassment comes in many forms, for Example: Sexual advances Requests for sexual favors Jokes or comments with sexual content or implications Gestures with sexual content Statements that “put down” someone based on gender or stereotypes about gender Pictures or posters with sexual content Hugs, massages or other touching

10 Examples of Conduct that Might be Sexual Harassment Offensive gestures or noises Sexist statements Offensive pictures or posters Inquiring into the personal life of a co- worker or student Compliments Looking at a person’s body instead of his/her eyes

11 Employee Vulnerability Hugs Putting students on laps One-on-one conferences Driving students Faculty/student parties

12 Federal and Texas Laws Prohibit Sexual Harassment SEXUAL HARASSMENT = SEX DISCRIMINATION Sexual harassment of students is discrimination on the basis of gender under Title IX. Franklin v. Gwinnett County School112 S.Ct. 1028 (1992) Sexual harassment of employees is discrimination on the basis of gender under Title VII. Meritor Savings Bank v. Vinson 106 S.Ct. 2399 (1986)

13 Key Word: UNWELCOME Conduct that may be offensive to one person may not be to another The “victim” has an obligation to tell the actor that she/he finds the conduct offensive If the behavior continues beyond that point, then it is sexual harassment.

14 Employee-to-Student Harassment FORBIDDEN ! Regardless of whether the student “welcomes” the conduct. Romantic or inappropriate social relationships between students and District employees are prohibited. Any sexual relationship between a student and a District employee is always prohibited, even if consensual. [See DF]

15 How Do I Prevent Being Accused of Committing Sexual Harassment? Educate yourself Be sensitive and perceptive when interacting with others Keep all actions job-related Avoid personal relationships with students Try to never be alone with a student

17 REPORT SEXUAL HARASSMENT TO: GENARO MARTINEZ DIRECTOR OF HUMAN RESOURCES 817-252-2003 (STUDENTS AND ADULTS)  What to do if you are sexually harassed Report the harassment to your principal or supervisor, request in writing an investigation of your complaint, keep a copy. Notify the Title IX coordinator of your sexual harassment and report to your supervisor
