2 Transfers

3 Transfers – Why Permittee must be the party in day to day “supervision and control of activities occurring at the construction site” When operators change, the permit coverage must be transferred to the new operator

4 Transfers - Operator Changes When a “lot” is sold to a builder/real estate company/investor When a contractor is done, but the site is not “finally stabilized” The road, building, facility is built, but surrounding grounds are not revegetated When one operator is bought by another or assets are transferred between operators Etc.

5 Transfers – Time Frame Transfer of authorization must occur within 14 days of change in ownership or operational control First owner is responsible for permit compliance until transfer is official

6 Transfers – How Notice of Transfer and Acceptance (NOTA) Signatures of both previous and new permittees Confirming correspondence to BOTH parties Copy of updated SWPPP to new permittee Copies of previous 12 months of inspection reports to new permittee New permittee updates or rewrites SWPPP within 30 days of transfer

7 Partial Transfers Working on a new NOTA that will accommodate partial transfers Right now the party taking on part of a project must submit a new NOI while the previous permittee removes the transferred property from SWPPP.

9 Terminations - When Are You Done? Site is entirely finally stabilized Built over of revegetated with a vegetation canopy that is uniform and at least 70% as dense as typical background veg and temporary ESC controls have been removed. Lot is sold, with a home, to the new homeowner Provide Homeowner Fact Sheet if lot not fully landscaped

10 Terminations - NOT When site meets conditions to end permit coverage, submit a Notice of Termination (NOT) right away Subject to permit conditions until coverage is formally ended Inspections, BMP maintenance, etc. DEQ spot checks sites that have submitted termination requests Confirming correspondence sent to permittee Early terminations do not result in refund of permit fees
