2 Slide 2 Ch. 2-1 Definitions of Crime A.Criminal Law vs. Civil Law 1.A crime is a public wrong, an offense against society. 2.A tort is considered a private wrong, an offense against an individual. 3.A crime will result in legal action by the government 4.A tort will result in legal action by one person against another. 3 Slide 3 A.Criminal law v. Civil law 1.Criminal law encompasses both substantive criminal law and procedural criminal law.. 2. Substantive law defines proscribed behaviors and specifies penalties. a) Laws concerning murder, rape, and robbery are substantive in that they define the elements of the crime. Procedural law consists of rules stating how the government proceeds against an individual accused of committing a crime. a) Right to a trial by jury, the right to counsel, the right to appeal, and the right to face one's accusers are just a few examples of procedural law. 4.Violations of these rights by the government are violations of due process and can result in a case being retried or even dismissed.
