3. Overview: How is Storm Water Regulated Under the EPA’s NPDES Program? Phased approach to regulation –Phase I (1990): Regulated discharges from large and medium MS4s serving >100,000 and eleven categories of industrial activity, including large construction > 5 acres - §402(p)(2) –Phase II (1999): Regulated discharges from small MS4s and small construction > 1 acres - §402(p)(6).

4. Overview: Phase I in Rhode Island DEM promulgated Phase I Regulations (1993) No Phase I Municipalities in Rhode Island Issued two (2) General Permits –Industrial Activity –Construction Activity Individual Permits for Industrial Activity

5. Overview: EPA Phase II approach for operators of municipal separate storm sewers (MS4s) Focuses on smaller municipally owned or operated storm sewers in urban areas Promotes pollution prevention through non- structural BMPs vs. end of pipe treatment through structural BMPs. Promotes maximizing resources through flexible permitting options

6. Overview: State Role and Responsibility Amend RIPDES Regulations to incorporate Phase II Rules Develop a state-wide criteria and process to designate small MS4s other than those automatically designated Develop and Issue Permits and application guidance Grant Waivers (when applicable)

7. Overview: Draft RIPDES Phase II Regulations Storm Water Work Group Meetings: Stakeholder group of municipal officials, non- governmental organizations, business community, RIDOA, RIDOH, RIDOT, and EPA Met 5 times from August 2000 - April 2001 Goals: Produce draft RIPDES Phase II Regulations Solicit comments and concerns from stakeholders Coordinate with other programs

8. Overview: Draft RIPDES Phase II Regulations (cont’d) Results: Maintain flexibility in Regulations and provide detailed guidance Provide incentives for protection of sensitive resources Designation of MS4s outside of urban areas

9. Overview: Future Deadlines March 10, 2002 - Operators of small MS4s may apply for waivers. March 10, 2003 - Operators of small MS4s must submit an application and Storm Water Management Program Plan. March 10, 2003 - Operators of municipally owned or operated facilities with Storm water discharges associated with industrial activity must submit permit application.

10. Overview: Future RIDEM Deadlines December 8, 2002 - RIDEM to develop a menu of Best Management Practices (BMPs). December 8, 2002 - RIDEM to Develop General Permit(s), for small MS4s and construction activity 1-5 acres December 8, 2002 - RIDEM to Grant waivers March 10, 2003 -RIDEM to Issue Permits
