1 2014-2017 FWPS/FWEA Negotiated Bargaining Agreement Collective Bargaining 101 Due Process/Right to Representation

2 “The parties believe that good communications and clear expectations can resolve many staff behavior issues prior to the imposition of formal discipline.” Administrators are encouraged to attempt to resolve issues with staff through pre-disciplinary strategies:  Oral or written clarification of expectations  Verbal Warnings  Letter of Direction * Due Process * If the offense is considered “egregious” a letter of direction could be bypassed for a letter of reprimand.

3 The parties believe in a philosophy of progressive discipline. Such discipline shall be for just cause and may include:  documented oral reprimand  written reprimand  suspension without pay  termination of employment.

4 “A staff member who is being directed to attend a meeting where discipline will be imposed must be notified that they have the right to have representation be present at such meeting.” You are responsible to find representation for the meeting. Ask an Association Rep, Executive Board Rep. You have the right to schedule the meeting time when all parties can be present. You may ask in writing the specific topic of discussion. 5 Section 7.2 - Definition and Focus of the Job Page 45 “Staff are expected to provide supervision of students in their care and during passing time.” ELEMENTARY  Walking students to/from lunch and recess, to bus/parent pickup. MIDDLE SCHOOL  May include walking students to and from lunch. Such supervision is not intended to reduce planning time, duty free lunch time, or professional time. Supervision* * New Language

6 Staff can be required to provide supervision at two (2) student activities occurring outside the student day which will be compensated as stipulated in the supervision compensation schedule. (ie. school dance, track meet, music program, etc.) Staff will not have scheduled supervisory responsibilities during their planning, student recess, and duty-free lunch times. Each elementary building will create, using consensus : A Rainy Day Recess Plan This “rainy-day recess” plan will include: –parameters for determining indoor or outdoor recess –determination of how to provide supervision of students –determination of locations for indoor recess In Addition…
