Opening Statement May it please the Court, your honor, and ladies and gentlemen of the jury- the evidence will show in this case that the Defendant, Tony Maglica had lied and betrayed many promises he made to Claire. Claire worked hard for the company and for both of their personal lives to achieve success. Maglica v. Maglica Plaintiff’s Case

2 Reason For Lawsuit Recovery of damages from Tony Maglica for breach of contract Claire Maglica’s work and contributions to the company were based on the promises of Tony Maglica. Claire is bringing this lawsuit because Tony and her made an agreement that they would work hard together and that would split profits, liabilities and everything 50/50 because they loved each other. Claire made many contributions of money, labor, and love to help the business and their personal lives achieve success.

3 Undisputed Fact of the Case
May 14 is the date celebrated each year as Tony and Claire’s wedding anniversary. Claire played an important role in the business; decisions were made by her and she was the eyes and ears for Tony Maglica is regards to the business. Claire made significant contributions to the company Tony and Claire would always celebrate May 14th because when they shared those vows on that day they knew that before them and God that they were married in their hearts. Claire worked hard for Tony and the company that Tony said that she was the “eyes and ears” for him. Tony and Claire did many business tasks in the same office and relied on each other before decisions were made.

4 Clair Maglica Testimony
What happened two months after May 14, 1971? We had been talking about a marriage, we both know we weren’t divorced, he said he doesn’t want to let me go, no other of our marriages were in the eyes of God, but this one would be performed in a church. We stopped at Tiffany and he bought me the wedding band I wear to this day. We walked down St. Patrick’s Cathedral we walked down the side altar we knelt down and exchanged vows. Claire took the vows she made with Tony very seriously and she did whatever she could to help Tony whether it be for the business or the family.

7 Tony Maglica Testimony
What was Claire’s role at Mag Instrument? She (Claire) is a person I could trust that I felt I would spend the rest of my life with. Someone I could relate everything, I felt she will be a person who would tell me exactly what happened through the company. We can see from Tony’s testimony that Claire worked to the best of her ability and provided her fair share of the agreement that Tony and her made when they first decided to be together. Claire did this because she felt that they would be sharing everything 50/50.

8 Conclusion Claire Maglica is entitled to half of the companies earnings because even though there was a signed separate property agreement, they were still married before God and each other. Claire made sure to fulfill her promises and when she worked for Tony he relied on her every step of the way. Claire also tried very hard to make sure the company was profitable and efficient by being present with most important meeting. Based on the evidence and the testimonies, it is obvious that Claire is entitled to half the interest of the company. She stuck to her vows and she work hard for her husband for 30+ years. Please put yourself in her shoes and imagine working hard for 30+ years on top of being a faithful wife and then have everything taken away and being left with nothing just because you were lied to by your husband. No one deserves this type of treatment.

9 Tony Maglica Tony has no problem relying on his wife’s hard work for the company and accepting all the profits. Tony doesn’t care what he has to do to not follow through with the promises he made to Claire. Tony Maglica loves to portray a hard worker with good ethics and that is how he got his position where he is. What he would not have you know is how he has taken advantage of his wife through the years and has given her no interest of the company.
