Readiness and Response. 7/22/2010 Electronic Discovery Process University of Houston

The Traditional Electronic Discovery Process Data collection Data preparation & processing Data review Data production

Data Reduction Scenario – Prevail Cull out Sys/Prog/App files (.dll,.ini,.exe,.help, etc.) Remove/Flag duplicates (aka Deduplication) Other culling: eg. search terms, date, file type, etc. Subjective privilege review (Prevail) Entire Collected Data Set Production 1 TB of raw native data Assume 25% reduction 750 GB (screened data) Assume 25% reduction 562.5 GB (unique data) Assume 50% reduction 281.25 GB (live data) Assume 75% reduction ~ 70 GB (responsive data) Assume 75,000 pages/GB ~ 5,25M pages (production set)

Prevail Review Application Matter Summary View  Matter Summary View provides a high level administrative view into the matter  General matter information  Individual user statistics  Overall review progress  Publishing history for data coming into Prevail  Individual login and logout time is tracked

Folder View  Folder View provides a Windows Explorer ® - like view of the data set  Left hand window provides a means to drill down into various folders as they were collected from user desktops and servers  All user naming conventions are preserved  Right hand window displays the files

Search Window  The Search Window is where most users will utilize the tool  The user starts by creating search criteria via dropdown  There’s a wide variety and large amount of flexibility in the types of searches  Search criteria can be saved and shared with other users (workflow and user task assignments)  On-the-fly deduplication allows the for duplicates to be suppressed from the reviewer

Search Results Window  The Search Results window shows all the files that met the user selected search criteria  Total number of items found  Top half of window lists the individual files  Bottom half of window shows a preview of item selected  Double clicking on any item in the list will open up that file in HTML (Item) View

Item (HTML) View - EMAIL  The Item View shows an “enhanced native” view of any document  Basic information about this file is available in the header  All email metadata fields are immediately available  Subjective coding  Attachments (parent/child relationships) are preserved and available  Chain explorer provides more functionality  Code the message unit from anywhere in the chain as well as immediately apply to exact duplicates

Organizer View  Care and feeding of subjective codes or categories  Unlimited number of client defined categories (and folders)  Categories can go 3-deep with respect to parent/child relationships  Categories can be locked  Right hand window displays all items in category

Item (HTML) View - SPREADSHEET  Hidden rows, columns, and worksheets can be made available  Spreadsheet rows and columns are preserved  Scroll up/down and left/right, just like in native application  Color is preserved  Worksheets are paginated into the same view  Mouse-over for cell formulas and comments  Headers and footers are exposed in HTML  Always have one- click access to native document
