1 Wisconsin’s Pupil Nondiscrimination Law

2 No person may be denied: admission to any public school participation in the benefits of or be discriminated against in any curricular, extracurricular, pupil services, recreational or other program or activity because of:

3 Sex Race Religion National Origin Ancestry Creed Pregnancy Marital or Parental Status Sexual Orientation Physical Disability Mental Disability Emotional Disability Learning Disability

4 “Discrimination” is defined as: any action, policy or practice which is detrimental to a person or group of persons and: Differentiates or distinguishes among persons, or Limits/denies opportunities, privileges, roles, rewards Or perpetuates the effects of past discrimination

5 Different Treatment: Detrimental treatment based on a student’s protected class status Facially neutral policies adopted with “invidious” intent

6 Disparate Impact: Adverse Impact from facially neutral policy Necessary to meet an important educational goal Comparably effective alternative

7 “Discrimination” also includes: Bias Stereotyping Pupil Harassment

8 “Pupil Harassment”: Behavior toward pupils which substantially interferes with a pupil’s school performance or creates an intimidating, hostile, or offensive school environment.

9 Complaint Investigation: “Find” facts (sometimes easy) Apply the law (always hard)

10 Complaint Investigation: Must provide a written acknowledgement within 45 days Final Resolution within 90 days Must inform complainant of right to appeal to State Superintendent

11 Complaint Investigation: Obligation: stop discriminating or take steps reasonably calculated to stop harassment

12 Self-Evaluation Due 2016-17 school year Participation Report to board board use Assurance to DPI

14 Wisconsin’s Pupil Nondiscrimination Law Self-Evaluation d. Trends and patterns of disciplinary actions, including suspensions, expulsions, and handling of pupil harassment e. Participation trends and patterns and school district support of athletic, extracurricular and recreational activities

15 Self-Evaluation f. Trends and patterns in awarding scholarships and other forms of recognition and achievement provided or administered by the school district g. School district efforts to achieve equality of educational opportunity and nondiscrimination
