FATAL MISTAKES WITH ALCOHOL CROSSROADS BY: JOSH HEATHERLY

BACKGROUND INFO Danny Foley and Paul Welby were best friends and so were their families The boys were eating dinner with Paul’s family and his parents were celebrating and offered the boys alcohol The boys were drinking at Paul’s house Paul’s parents then let Paul drive the family’s car to a summer party at a friend’s house

BACKGROUND INFO CONTINUED A state trooper saw the car speeding and went to pull the car over Paul panicked once he saw the car pulling him over and swerved and hit a telephone pole Paul suffered from broken bones and bruises Danny suffers from quadriplegia

COURT INFO There were 8 affidavits present George Baines MD stated that Danny would never fully recover-he has quadriplegia which will affect his life forever State Trooper was family friends with both of the families and said he panicked as soon as the car started to swerve State Trooper called for backup cause he saw the accident right as it happened and called the ambulance when he saw a body get thrown from the car

LAWS All states have adapted laws that the minimum drinking age is 21 years old All states now have a 0 (BAC) level for drivers under legal drinking age Parents are allowed to give their children alcohol at their own home It is illegal for parents to provide alcohol to teen’s friends at home Illegal to operate a vehicle after alcohol is in the system

LAW PUNISHMENTS Penalty for the first defense is suspension of license for 90 days, a fine of $700, and complete alcohol evaluation If person over 21 gives alcohol to minor knowing person is minor, and minor gets damage or injury, adult who provided it is responsible for any damage or injury caused by minor

COURT CASES Jones v. Anytown Raceway, inc Berry v. Enever Lu v. Lopez White v. Forrest Standing v. Janicek Black v. Ross, inc

ACTUAL OUTCOME Paul’s license suspended for 3 months and fined $700 Danny’s parents sued Paul’s parents for providing minors with alcohol and letting them drive This event ruined their family friendship and almost bankrupted Danny’s family

OUR THOUGHTS We believe that Paul’s license should have been suspended longer and the fine should have been more Paul’s parents should have to pay payments towards Danny’s hospital bills because it was them who offered alcohol and their son who was driving the car
