14 Q5: Is a child formally placed in family maintenance considered a foster child? If yes, will that child be directly certified to receive free school free meals? * A5: Per the definition of foster child in the Eligibility Manual for School Meals, for a child to be considered a foster child and receive categorical eligibility for free meals, their care and placement must be the responsibility of a State child welfare agency or the court. This does not apply to informal arrangements or permanent guardianship placements that may exist outside of or as a result of State or court-based systems. In essence, the State must retain legal custody of the child. * If the child placed in “family maintenance” was placed by a State agency or the court, and is still the responsibility of the State, they may be considered foster. * It is also important to note that the child’s status as a foster and eligible for free meals is taken at face value, as with income applications.
