INCS expert institution for nature conservation founded in 1948. by the Government main activities: planning of protected area (studies for protection), monitoring and conservation of biodiversity and geodiversity, expert support for PA managers, education in nature conservation…. According to Law on nature protection: issuing of acts on “conditions for nature protection” for projects and plans

WINDPARKS First applications in 2008. 18 applications for conditions for nature protection Locations: Vlasina, Čemernik, Svrljiške Mt., Ljubinje, Kladovo, Negotin, Krivača, Veliko Gradište, Golubac, Vinci, Čestobrodica, Boljevac, Priboj-Prijepolje, Kostolac, Nikine vode, Malo Crniće... Often overlapping with protected areas and/or other areas significant for nature conservation

LEGISLATION Law on nature protection – only areas with 1 st level of protection excluded Law on EIA (10 MW threshold, projects in PA) Law on SEIA Law on planning and construction Decree on protection regimes Rulebook on protected species Rulebook on special measures for migrating animals (continual monitoring for WP over 50MW?)

5 . ACT ON CONDITIONS FOR NATURE PROTECTION Data on protected areas, species and habitats Areas to be excluded by the project/ limitations Elements for EIA- bird/bat monitoring Specific conservation and mitigation measures

ACT ON CONDITIONS FOR NATURE PROTECTION Monitoring: Minimal duration: 1 year at least two surveys per month and three during reproductive period Issues to be assesed: species, population estimates, migration patterns, seasonal dynamic, important locations… Data should include: precise locations, flight directions, height, behaviour sometimes target species/locations are defined in the act monitoring results should be considered in planning of a wind park (exclusion or relocation of problematic WT)

7 . ACT ON CONDITIONS FOR NATURE PROTECTION Conservation/mitigation measures shut down of WTs in sensitive periods removal of dead animals and vaste from the area of a windpark agricultural measures: using of less attractive crops for birds, efficient removal of crops removal or adaptation of other objects attractive for birds (poles, trees, ponds...) reduced lights objects should be safe/unattractive for animals coloring of WT blades? Post-construction monitoring!?

CHALLENGES Lack of strategic approach (Strategy/Action plan for wind power) SEIA avoided in most of the projects Lack of capacities on local level (EIA process); Expert revision of EIA Lack of endorsed monitoring methodology/standard; Limited expert capacities for monitoring/EIA Enforcement of the INCS conditions Regulation of post-construction monitoring and management Cumulative impact- lack of legal support and capacities for assessment

SOLUTIONS Improved cooperation of INCS and other expert institutions with local and national authorities on EIA/SEIA Endorsement of minimal standards for monitoring (effort defined in hours per vantage points, CR analysis…) Improved legal support for post-construction monitoring Revision of the rulebook on special measures for migrating animals Adopting of Decree on appropriate assessment (ocena prihvatljivosti) Cumulative impact- SEIA procedure
