2 LODA - Who’s Covered? Public safety hazardous duty employees and volunteers Fire Suppression, Law Enforcement, or Emergency Medical personnel

3 LODA – Statute Training Code of Virginia, Section 9.1-407 Any law-enforcement or public safety officer entitled to benefits under this Chapter shall receive training concerning the benefits available to himself or his beneficiary in case of disability or death in the line of duty. The Secretary of Public Safety shall develop training information to be distributed to agencies and localities with employees subject to this Chapter. The agency or locality shall be responsible for providing the training. Such training shall not count towards in- service training requirements for law-enforcement officers pursuant to § 9.1-102.9.1-102

4 LODA - Death Benefit For deaths occurring after January 1, 2006 Death occurring as the direct or proximate result of the performance of duty Includes death by presumptive clause or within five years of retirement

5 LODA – Injury Benefit For injuries occurring after January 1, 2006 Injury occurring as the direct or proximate result of the performance of duty Includes injury by presumptive clause or within five years of retirement

6 LODA - Waiver of Tuition Child of LODD between the ages of 16-25 Free undergraduate tuition and fees Public institution or other accredited school located in Virginia

7 LODA - Health Insurance Who’s covered? – The disabled member – Surviving spouse – Dependent children, under some circumstances Equal or equivalent to level of insurance available to a regular Albemarle County employee.

8 LODA - Burial Expenses County to pay up to $10,000 in expenses Up to $1,000 for transportation of the deceased Death benefits may be advanced to pay funeral expenses when a death is likely to be covered under LODA. If the death is subsequently determined not to be covered, previously-paid expenses may be deducted from other benefits owed to the beneficiaries.

9 LODA – Claims Process To file a claim: – Contact Albemarle County Human Resources – Investigation occurs once claim is submitted – Approved or denied by the Virginia State Department of Accounts – Different forms for different benefits – Appeals process exists

10 Federal Benefits Public Safety Officer Benefits – Provided through Department of Justice – More stringent guidelines – LODD provides $295,000 to survivors – Disability assistance for full disability
