3 Sexual Abuse/Assault Facts: Source; FBI and US Attorney’s Office (2004) ► 1 in 3 women will be raped in their lifetime ► 1 in 10 men will be raped in their lifetime ► 1 out of 6 males will be assaulted by age 18 ► 7 out of 10 teen girls that are attacked, are attacked by their date or their boyfriend ► Assailants under the age of 18 are responsible for committing 30% of all sexual assaults ► 10% of rape victims are under the age 5 ► 20% of rape victims are under the age of 12 ► 35% of rape victims are between ages 11-17 ► 84% of all victims know their assailants ► The average sex offender has 7 victims before they are caught ► The average child molester has 76 victims before they are caught

4 Profiles of Sexual Assailants: ► Power Assailants:aggressive attackers that use force to overpower their victims by attempting to prove their masculinity or femininity by dominating their victims ► Anger Assailants:revenge motivated attackers that were often victims of child abuse and are trying to even the score ► Sadistic Assailants: emotionally disturbed, mentally unstable, or psychologically ill who often torture, injure and/or kill their victims

5 Illinois Criminal Code Legal Definitions: ► Consent: the freely given agreement by two adults to willingly participate in the act of sex.  It is ILLEGAL for Adults to have sex with minors.  It is ILLEGAL for Minors and Children to consent to have sex with an adult  ALL Sexual Activity with minors and children is considered to be non-consensual ► Children: age 12 and under ► Minors:ages 13 to 16 ► Adults:age 18 and up +17 is the Age of Consent in Illinois. + However, 17 year olds can be considered either a minor or an adult, depending on the a minor or an adult, depending on the circumstances involving the sexual offense

6 Illinois Criminal Code Legal Definitions: ► Misdemeanor:criminal offense with a maximum sentence of 364 days in the county jail, fines, court costs, attorney fees ► Felony:criminal offense with a minimum sentence of 1 year in state or federal prison, fines, court costs, attorney fees

7 Illinois Criminal Code Legal Definitions: ► Date Rape/Acquaintance Rape: slang terms for sexual attacks that occur on dates or within relationships that people know each other ► Statutory Rape: unlawful sexual activity or sexual intercourse between a minor and an adult ► Stalking/Predatory Sex: following someone and keeping them under surveillance for the purpose of sexually attacking them ► Cyber-sex: sexual predators using the internet to lure victims into online pornography and unlawful sexual conduct

8 Illinois Criminal Code Legal Definitions: ► Random Violence: violence committed against someone for no particular reason. ► Physical Abuse: intentionally injuring or causing physical harm to another person. ► Assault: the threat or attempt to strike another, whether successful or not, provided the target is aware of the danger. ► Battery: the actual intentional striking of someone, with intent to harm, or in a "rude and insolent manner" even if the injury is slight.  Assault and Battery: the combination of both

12 Illinois Criminal Code Sexual Offenses: Laws and Penalties: ► Aggravated Sexual Offenses: all sex crimes can be upgraded to aggravated if any of the following occur;  force or threat of force is use in the attack  victim is under age 13 or over age 60  victims suffers bodily harm during the attack  weapons are used to commit the attack  victims are physically or mentally handicapped  intentionally using alcohol or drugs to commit the sexual attack

17 Aggravated Sexual Assault and Domestic Battery * John Wayne Bobbitt; gained national notoriety as a victim himself, when his wife made him famous by cutting off his penis in retaliation for his ongoing, continuous abuse towards her. Lorena Bobbitt then drove away, tossing the penis out her car window. A police search ensued to locate the missing penis, which was found and surgically re- attached. The incident led to a trial where Lorena Bobbitt was found innocent by reason of insanity, and in a separate trial, Bobbitt was found guilty of battery, but he was acquitted of sexually assaulting his wife.

18 Aggravated Sexual Assault with a Minor: * Mary Kay Letourneau; the 35-year-old elementary school teacher, and married mother of four; pleaded guilty in 1997 to having sexual relations with 13- year-old Vili Fualaau. Vili would later testify that they had sex some 300 to 400 times with Mary Kay. She served a seven-year sentence in prison. Letourneau has two daughters fathered by Fualaau, and they were married on April 16, 2005.

19 Aggravated Sexual Assault with a Minor: * Debra Lafave; 25 Tampa Bay teacher reaches a plea bargain agreement resulting in a guilty plea for two counts of lewd and lascivious behavior with a minor after being sexually involved with a 14 year old student. She was sentenced to three years of community control or house arrest, seven years of probation, and ordered to register as a sex offender.

20 Aggravated Sexual Assault with a Minor: * Pamela Joan Turner; the 27-year-old Tennessee woman is the latest teacher to be arrested for allegedly carrying on a sexual relationship with a student, in this case a 13-year-old boy. Turner, a Teacher at Centertown Elementary School, was charged with 13 counts of statutory rape and 15 counts of sexual battery for encounters with the child, which allegedly occurred at school and in the boy's home.

27 Is your boyfriend or girlfriend... * Jealous and possessive towards you; won’t let you see or talk to friends and family, checks up on you, won’t accept breaking up? * Embarrassing you with degrading names and insults? * Forcing you to have sex or forcing you to perform sexual acts you do not want to do? * Saying that you provoke him/her, press his/her buttons, saying that you made him/her do it, or that you led him/her on? * Controlling, trying to be very bossy, giving orders, making all of the decisions, not taking your opinion seriously? * Are they violent? Does he/she have a history of fighting, losing his/her temper quickly, or bragging about mistreating others? * Abusing drugs and alcohol and then pressuring you to do them?

30 Preventing Sexual Attacks ► Know who you are going to be with and where you are going to be. ► Know if drugs and alcohol are going to be readily available and avoid them. ► Recognize warning signs of potential abuse. ► Avoid controlling and dominating people. ► Be Assertive; When you say NO, Mean It! ► Trust your instincts, if you suspect something is not right, it probably isn’t.

32 Date Rape Drugs: ► “Date Rape” Drugs: drugs, medicines, or alcoholic beverages used to incapacitate and take advantage of victims for the purpose of a sexual attack Common “Date Rape” Drugs:  Alcohol  MDMA (XTC/Ecstasy)  GHB (Gamma Hydroxybutyrate)  Rohypnol (Roofies)  CAT (Ketamine)  Quaaludes (Ludes)  Methamphetamine (Crank, Crystal Meth)  Tobacco or Marijuana Dipped in Embalming Fluid or PCP

35 Date Rape Prevention * Don’t leave drinks unattended *Don’t accept open containers at parties *Avoid Party Punches or Party Bongs *Be aware of what might be in Jell-O Shots *Have a Back Up Plan if you are in a potentially dangerous situation *Accept drinks only from bartenders or servers and watch them open it

36 Prevention Strategies: ► Establish Sexual Limits and Communicate ► Double Date or Group Date until you feel safe and secure on the date ► Avoiding Drugs, and Alcohol  Being on the look out for Date Rape Drugs ► Be cautious of Blind Dates; Learn as much as you can about the person ► Avoiding controlling, dominating people ► Learn simple self-defense techniques

37 Prevention Strategies: ► Passive Approach: being victim minded; giving in, giving up, not standing up for ones rights, easy targets for assailants ► Assertive Approach:standing up for ones beliefs, being firm and decisive, being pro- active, acting with conviction ► Aggressive Approach:being overly forceful, and hostile; this approach may be necessary as a defense in some situations during an attack

38 What to do if you are Attacked: ► Report the attack to police ASAP ► Get a medical exam ► Get tested for STD’s, HIV, and pregnancy ► Don’t take a shower or bath until examined ► Don’t discard any potential evidence ► Contact a Rape Crisis Center ► Contact an Attorney ► Get counseling, join a support group

39 Who to Contact if you are a Victim: ► School Officials:  Counselor, Social Worker, Psychologist  Administrator, Teacher, Coach ► Police Consultant or Local Police ► State or Federal Law Enforcement ► Rape Crisis Center (NWCASA) ► Local Hospital or Emergency Clinic ► Department of Children and Family Services ► Department of Public Health

40 ► I have the right to refuse a date without feeling guilty. ► I have the right to ask for a date without feeling inadequate or rejected if the answer is NO. ► I have the right to be treated with respect and dignity. ► I have the right to dress the way I want without being attacked. ► I have the right to say no to sex at any time without feeling threatened. ► I have the right to date without being sexually active. ► I have the right to be myself without having to change myself to suit others desires. ► I have the right to an equal relationship with my partner. ► I have the right not to be dominated by someone else.
