2  Uninsured Motorist- An 'uninsured motorist clause' is a provision commonly found in United States automobile insurance policies that provides for a driver to receive damages for any injury he or she receives from an uninsured, negligent driver  Coverage- The extent to which something deals with or applies to something else.  Regular Use- Used Frequently

3  Pease was an officer that was called to respond. He drove his patrol car to the scene. He came to Montagna, the person causing the problem. While confronting him, Montagna ran and jumped in the patrol car. Pease tried to stop him but was run over by the car and dragged under it. He suffered serious injuries. Montagna has no assets and his auto insurance policy does not cover his unlawful possession of Pease’s patrol car. The sheriff’s office did not carry uninsured motorist coverage for its patrol cars. Pease then sued State Farm, his auto insurance company, for uninsured motorist coverage. The district court held for State Farm. Pease appealed.

4  Exclusions and exceptions in insurance policies are broken and are interpreted against the insurer. The policy excluded a vehicle “furnished for regular use” that was the patrol car. However, when Montagna stole the patrol car, it stopped being a vehicle furnished for the insured’s use and was simply a stolen vehicle. Hence, the policy covers the injury suffered by Pease.
