3 International Telecommunication Union New Delhi, India, 19-20 December 2011 Industrial Keynote Speakers Dr. Debabrata Nayak (HUAWEI) emphasized the need to identify the Indian patents to be used for Indian standards, and the importance of GISFI in this procedure. Mr. Ajay Ranjan Mishra (Nokia Siemens Networks) noted the importance of standards for interoperability, and the need of a standardization body in India.

15 International Telecommunication Union New Delhi, India, 19-20 December 2011 Session 3 : Industries’ Perspectives: Part II Mr. Serge Raes (France Telecom) Presented the mechanism of patent pools A model for licensing based on IPR included in standards brings the question of evaluation of RAND and essential patents The 3G LTE example outlined the problem of the plural essential patents and the potential advantages of a patent pool Benefits are more substantial than drawbacks for SME patent holders Operators could also profit from patent pools

17 International Telecommunication Union New Delhi, India, 19-20 December 2011 Session 4: Public Authorities Mrs. Anne Lehouck (European Commission) Gave an overview of - the European standardization policy - Attributes for ICT Fora and Consortia in the proposed regulation and of the EU competition rules re horizontal co-operation agreements FRAND principle is an acceptable solution in Europe Presentation of past and future EC workshops re IPRs

18 International Telecommunication Union New Delhi, India, 19-20 December 2011 Session 4: Public Authorities Mr. Arun Golas (TEC) Necessity to conform to standards and the benefits of standardization, especially in the ICT field Overview of standardization in India Role of TEC in the formulation of technical requirements Necessity for certification of telecom products Proactive role for India (involving all stakeholders and accademics) Necessity for the creation of an Indian standards organization

19 International Telecommunication Union New Delhi, India, 19-20 December 2011 Session 4: Public Authorities Mrs. Tomoko Miyamoto (WIPO) Highlighted the objectives of the patent system Incentives to innovate and knowledge sharing Common objectives of patents and standards with potential conflicts of interests Proper functioning of the patent system should help in dealing with the increase of patent numbers WIPO SCP Results of the « standards and patents » report Focus of the committee’s work on patent quality Efforts to disseminate patent information (WIPO patent scope) to increase transparency Activities and benefits of WIPO’s arbitration and mediation center were introduced

22 International Telecommunication Union New Delhi, India, 19-20 December 2011 Session 5: Software Copyright Issues Mr. Hung Ling (Alcatel-Lucent) Emphasized that the innovation standardization virtuous cycle helps companies to differentiate each other and ensures that customers are provided with the best technology on the market. As a result, software cannot be mandated to standards implementers; and if so, specific rules are needed in the SDOs/SSOs IPR policies A global company benefits from unified rules re IPRs in SDOs

23 International Telecommunication Union New Delhi, India, 19-20 December 2011 Session 5: Software Copyright Issues Mr. Serge Raes (France Telecom) Explained different definitions of software and the specific regime for codecs The overhaul objective in standards is to avoid incorporation of unidentified 3rd parties in order to avoid contamination Specific examples of source code contributions in the ITU IPR database Example of France Telecom strategy

25 International Telecommunication Union New Delhi, India, 19-20 December 2011 Session 5: Software Copyright Issues Mr. Wadsworth (Qualcomm, on behalf of ITU) As in ETSI, there is a general discouragement for using software in ITU recommendations ITU’s existing guidelines on software were recently improved Different types of software Issues of representation and warranties Negation of implied patent licenses and licensing arrangements (5 options) for the different uses of the software

28 International Telecommunication Union New Delhi, India, 19-20 December 2011 Session 6: Academia Perspectives Dr. Stephan Gauch (Fraunhofer Institute) Summary of research findings on standards and IPR Telecommunications technologies provide the most essential patents in standards Non-Practicing entities identified as a threat by the industry Interesting results of studies were cited IPR does not seem to destabilize standards Clear rules and transparency were praised
