Open Access is free online access to research literature via the public Internet  Gratis OA is no cost online access  Libre OA is Gratis OA plus removal of at least some permissions barriers Open Access should be immediate, not delayed, and should apply to full text and associated datasets, not just abstracts or summaries

5 WORLD BANK Publications The reference of choice on development Open Access as Defined in the Budapest Open Access Initiative Free availability on the public internet, permitting any users to read, download, copy, distribute, print, search, or link to the full texts of these articles, crawl them for indexing, pass them as data to software, or use them for any other lawful purpose, without financial, legal, or technical barriers other than those inseparable from gaining access to the internet itself. The only constraint on reproduction and distribution, and the only role for copyright in this domain, should be to give authors control over the integrity of their work and the right to be properly acknowledged and cited."

7 WORLD BANK Publications The reference of choice on development The World Bank’s Draft Open Access Policy Final manuscripts and all associated primary data sets to be deposited in the institutional open access repository, the Open Knowledge Repository  A final manuscript is the last word-processed version of a document, in the form accepted for publication after completion of the internal peer review, vetting, and/or approval process Includes manuscripts published through an external publisher and reports by outside researchers who received World Bank funding

14 WORLD BANK Publications The reference of choice on development The Challenges of CC-BY Loss of commercial incentives for for-profit publishers to translate, publish, and distribute Bank titles locally Reputational risks  Anyone can translate or adapt and publish a Bank book How do we uphold quality standards?  Anyone can create a website with Bank content and include materials the Bank would find offensive and objectionable Would we have the right to redress? Legal issues  Bank Publications often include chapters contributed by non-Bank researchers We have to ensure we have proper rights to publish under a CC license  No US court has addressed whether CC licenses are enforceable as contracts If the Bank were forced to bring a claim, a court may not accept that the CC license grants the Bank any legal rights  Paragraph 8.f discusses various applicable laws and treaties. The Bank is not subject to national courts and laws and is not a party to the treaties cited. Accepting these clauses raises the risk of an implied waiver of the Bank’s “privileges and immunities.”  The license does not include an arbitration clause An attribution clause is important to avoid being brought before national courts.

15 WORLD BANK Publications The reference of choice on development Conclusion The Bank should embrace open access publishing  Implement an open access policy  Launch the Open Knowledge Repository  As a temporary measure, and in time for the launch of the OKR in April 2012, develop a CC-like attribution license that protects its privileges and immunities  Work with CC and the IGO community to develop a set of CC licenses that addresses the specific needs of IGOs, then implement the IGO CC-BY  Continue to support the publishing program as it reinvents itself and its business model
