1 GUIDANCE ON OCTOBER 1, 2014 EFFECTIVE DATE AMENDMENTS TO THE UNIFORM ACT MOVING AHEAD FOR PROGRESS IN THE 21ST CENTURY ACT (MAP-21).

2 SEC.3: EFFECTIVE DATES MAP-21 took effect on October 1, 2012 Uniform Act length of occupancy requirement and benefit limit increases take effect two years from that date on October 1, 2014 MAP -21 EFFECTIVE DATES

3 SEC. 1521: UNIFORM ACT AMENDMENTS Length of Occupancy requirement for homeowners was reduced from 180 days to 90 days in occupancy before the initiation of negotiations.

4 SEC. 1521: UNIFORM ACT AMENDMENTS Moving and Related Expenses  Business Reestablishment payments up to $25,000  Fixed Payments in lieu of actual moving and reestablishment up to $40,000 Replacement Housing for Homeowners  90 day homeowner - $ 31,000 Replacement Housing for Tenants  90 day tenants - $7,200

5 90-DAY ELIGIBILITY STANDARD Will apply whenever the initiation of negotiations with a homeowner occurs on or after October 1, 2014

6 NEW BENEFIT AMOUNTS APPLICATION Will apply whenever the initiation of negotiations with a homeowner occurs on or after October 1, 2014 This is based upon research regarding the application of prior statutory changes in relocation benefits

7 PROJECTS THAT STRADDLE OCTOBER 1, 2014 We anticipate that there will be projects on which the initiation of negotiations for some parcels occurs before October 1, 2014, but relocation assistance activities may not be completed until sometime after October 1, 2014.

8 HOW TO DETERMINE WHEN THE MAP-21 INCREASED BENEFITS MAY BE PROVIDED On and after October 1, 2014, the higher benefit limits apply to an individual who qualifies as a displaced person under the definition in 49 CFR 24.2(a)(9)(i) if:

9 For relocation benefits other than replacement housing payments for homeowners: The individual is not required to move from the acquired property before October 1, 2014, AND has not moved before that date. HOW TO DETERMINE WHEN THE MAP-21 INCREASED BENEFITS MAY BE PROVIDED

10 For replacement housing payments for homeowners: On or after October 1, 2014, the displaced person holds title to the real property to be acquired. HOW TO DETERMINE WHEN THE MAP-21 INCREASED BENEFITS MAY BE PROVIDED

11 49 CFR 24.401 (d) INCREASED MORTGAGE INTEREST COSTS- NOT CHANGED BY MAP-21 11 …….In addition, payments shall include other debt service costs, if not paid as incidental costs, and shall be based only on bona fide mortgages that were valid liens on the displacement dwelling for at least 180 days prior to the initiation of negotiations.

12 POLL QUESTION Q: If the title transfers prior to October 1 st (let’s say it transfers on 9/20/14), but the Notice to Vacate expires on or after 10/1/14 and the homeowner moves on or after 10/1/14, are they eligible for the new limits?

13 POLL ANSWER A: No- the trigger date for homeowners is the transfer of title, unless State Law has the new limits. In that case under 23 CFR 710.203 (b)(2)(ii) FHWA can participate in the higher amount
