2. Rule Basics In August 2014, CMS released a final rule that grants flexibility to providers who are unable to fully implement 2014 Edition CEHRT for an EHR reporting period in 2014 due to delays in 2014 Edition CEHRT availability.

3. Delays in 2014 Edition CEHRT Availability 42 CFR § 495.8 (a) (2) (i) (D) states: For 2014 only, if the EP uses one of the options specified under§ 495.6(a)(4) or (h)(3), the EP must attest that he or she is unable to fully implement 2014 Edition certified EHR technology for an EHR reporting period in 2014 due to delays in 2014 Edition certified EHR technology availability.
