2. California Integrated Waste Management Board Overview Surveillance is an integral part of Waste Tire Enforcement. Proactive surveillance programs stop illegal dumping of tires as well as other wastes, both hazardous and non-hazardous, and forms the basis for prosecution. ARB’s special surveillance team are experts in the use, planning, placement, and maintenance of surveillance equipment and have been doing this since 1995. ARB has program specialists in both covert and overt equipment surveillance operations. ARB will provide these surveillance services under the direction of the CIWMB Contract Manager.

3. California Integrated Waste Management Board Surveillance Needs Illegal disposal of waste tires continues to occur throughout California in both urban and rural settings. Local and state staff resources are insufficient for surveillance of suspected sites over extended periods of time. Prosecution of illegal dumpers requires sufficient evidence Manifest and enforcement activities need confirmation of program effectiveness.

4. California Integrated Waste Management Board Benefits of Surveillance Program Provides long term cost savings by reducing personnel costs. Reduces staff exposure to hazardous situations and environments. Offers statewide environmental benefits by sharing equipment with both local enforcement agencies and other state agencies. Allows for motion activated, remote control viewing, and extended digital recordings of suspected illegal dumping sites. Supplies evidentiary quality recordings, which are are acceptable in administrative and court proceedings. Permits recordings to be used for training purposes.

5. California Integrated Waste Management Board 5 Surveillance Services ARB will purchase surveillance and support equipment with CIWMB Contract Manager approval. ARB will store and maintain this equipment for the CIWMB. ARB will work with the CIWMB Contract Manager and staff to plan requested surveillance activities. ARB will provide guidance and assistance to CIWMB and local enforcement staff in conducting surveillance operations to support waste tire enforcement. ARB will provide the training and field experience necessary to allow CIWMB and local enforcement staff to independently perform these surveillance activities in the future.

6. California Integrated Waste Management Board Surveillance Equipment and Placement Surveillance needs vary and determine the placement method and equipment used. Equipment placement may be on poles, in power boxes, in vehicles, and other configurations depending on site specific needs. Equipment may be situated for covert or overt surveillance activities. Equipment may used either to confirm illegal activities or demonstrate compliance. Equipment can be configured to obtain both photographic or video evidence with secure date and time stamps.

7. California Integrated Waste Management Board How it will work CIWMB will own all equipment purchased under this agreement. CIWMB will have priority use on all equipment purchased under this agreement. CIWMB and ARB will work closely to coordinate timely responses to surveillance assistance requests. ARB will train CIWMB and local enforcement staff on preparation, placement, operation, and retrieval of equipment.

8. California Integrated Waste Management Board Internal Process Surveillance needs will be determined by CIWMB enforcement personnel, in conjunction with management and legal staff. Requests for surveillance assistance will be made to ARB through the Contract Manager. CIWMB field staff and ARB will work together to plan, install, monitor, and remove surveillance equipment. CIWMB or local enforcement grantees will be responsible for collection of evidence from surveillance equipment.

9. California Integrated Waste Management Board Major Tasks Determine CIWMB surveillance equipment needs. Decide on type of equipment to be purchased. Purchase Equipment. Cooperatively plan and implement surveillance activities. Provide training to CIWMB and local enforcement staff equipment use and surveillance techniques. Report quarterly on equipment usage and surveillance activities. Deliver final report at the end of the contract term.

12. California Integrated Waste Management Board Additional Information CIWMB and local enforcement staff have been working with Caltrans, CHP, and private companies to review current equipment specifications. CIWMB and ARB will continue a needs assessments until time of purchase. Equipment will continually be monitored for effectiveness. Adjustments in future equipment purchases will be made based on needs and evaluations. CIWMB may consider providing some or all equipment purchased under this agreement to the ARB with the understanding that CIWMB will have access rights. Several local enforcement staff have been using state-of-the-art surveillance equipment and have offered to add their experience to our efforts.

13. California Integrated Waste Management Board Recommendations Approve Resolution Number 2006-79 and the Proposed SOW and Agreement with the Air Resources Board to Purchase, Support, and Make Available Surveillance Equipment to Support the Special Waste Tire Enforcement Program.
