4 The North European Deep Sea Pilotage Authorities – NEDSPA Formation - following the event held in London by Trinity House in November 2008, it was decided by those Deep Sea Pilotage Authorities of the countries bordering the North Sea and Channel area to form a group aimed at co-operation and standardisation of Deep Sea Pilotage. 6 The North European Deep Sea Pilotage Authorities – NEDSPA 2010 developments Since I last reported, at Geiranger in June 2010, there have been no meetings, but some ongoing communication between the NEDSPA member countries aimed at agreeing the joint submission of a revised IMO Resolution A.486(XII): “Recommendation on the use of qualified Deep Sea Pilots in the North Sea, English Channel and Skagerrak”. I will cover this in detail later………..

8 UK Association of Deep Sea Pilotage Authorities Revised rules & Regulations In 2010 it was found necessary to review the Rules & Regulations governing Deep Sea Pilotage in the UK in order to the address: area boundaries for which pilots are licensed area boundaries for which pilots are licensed increases in fees for examination and revalidation increases in fees for examination and revalidation the retirement age of Deep Sea Pilots the retirement age of Deep Sea Pilots pilot affiliation with the relevant Agencies pilot affiliation with the relevant Agencies

9 UK Association of Deep Sea Pilotage Authorities UK Association of Deep Sea Pilotage Authorities Area Area The area for which Deep Sea Pilots were licensed was divided into four geographical areas, giving pilots the option of obtaining a license for one or all areas. As no application has been for less than the whole area for many years, it has been decided to remove the subdivision and have a single area for all pilots licensed in the UK.

10 UK Association of Deep Sea Pilotage Authorities Fees for Examination & revalidation It has been more than 10 years since the fees had been increased. Therefore, with effect from the 1 st January 2011 the fees in the UK are: Examination £250 Certification £60 Revalidation£125 The increases represent approximately a 10% uplift.

11 UK Association of Deep Sea Pilotage Authorities Retirement age The EU laws on employment were adopted in the UK in October 2010 through the “Equality Act”. This makes it illegal to use ‘age discrimination’ by prescribing a retirement age and protects, among others, self- employed people – such as Deep Sea Pilots. The 2007 UK ADSPA Rules specified that no pilot can renew his certificate after his 67 th birthday. This has been removed in the new Rules, effective January 2011 in order to avoid legal challenge over age discrimination. Pilots can continue as long as they have valid STCW and medical certification. They must also be affiliated to a recognised Deep Sea Pilotage Agency.

13 The UK Deep Sea Pilotage Agencies UK licensed Deep Sea Pilots are self employed Master Mariners affiliated to an Agency who provide pilots to client shipping companies, operators and charterers. The pilots generally join / leave vessels at Brixham or Cherbourg and serve onboard for an average of 9 days during the European port rotation

16 What are the advantages of carrying deep sea pilots?  Reduce risk in very congested waters  Awareness of changes to aids to navigation  Local knowledge and experience  Skill in shallow confined waters and strong tides  Knowledge of hazards; Rigs / Windfarms  Ease high intensity Port rotation schedules  Frequency of adverse weather/reduced visibility  Overcome any lack of experience of the area  Reduction in crew stress and fatigue  Increased safety and reduced operating costs

17 24 hours in Dover Strait The density of traffic and degree of risk in Dover Strait continues to cause concern and authorities agree that there must be a measure of traffic control in due course. Deep Sea Pilots will need to play a key role in and risk control measures. The North European Deep Sea Pilotage Authorities

18 A moment in time - the advance of AIS technology allows us to identify all vessels over 300gt, and assess the risk. Surely we must be moving toward using all measures at our disposal to avoid collisions and groundings? 21 The North European Deep Sea Pilotage Authorities ECDIS Training Master Mariners revalidating their CoC after 1 st January 2012 are to have completed the IMO / STCW Model 1.27 course on generic ECDIS Training. Thus ensuring that all users are trained as ECDIS carriage becomes mandatory 2012 - 2018 It has been agreed with the UK MCA that the type specific training is not applicable to Deep Sea Pilots due to the nature of their work

22 The North European Deep Sea Pilotage Authorities ECDIS Training Generic ECDIS Training is a 5 day course at a cost of about 700 Euros with likely travel and accommodation costs of about 500 Euros. This comes at a time when many Deep Sea Pilots have seen their work and income substantially reduced due to the downturn in shipping due to the recession. The UK Authorities require a full valid CoC at renewal each year.

23 The North European Deep Sea Pilotage Authorities European Directive 2009/16MCA MIN380 Severe sea and coastal pollution associated with the loss of the tankers “Erica” and “Prestige” in 1999 and 2002 led to a programme of European legislation. Measures introduced were changes to Port State Control, one of which is EU Directive 2009/16 to replace existing Directive 95/21. The UK brought this into legislation on 1 st January 2011 through MCA MIN380. This notifies Owners and Masters of the changes to Port State Control regulations and includes, at clause 3.11: “current reporting requirements by port pilots and port authorities of ship related anomalies will be extended to deep sea pilots.”

24 The North European Deep Sea Pilotage Authorities European Directive 2009/16MCA MIN380 European Directive 2009/16 MCA MIN380 Deep Sea Pilots and their representative bodies, are concerned that this requirement may compromise their relationship with their clients – the shipowners, charterer’s and masters who choose to take deep sea pilots on their European port rotation. Pilots onboard for an average 9 days, and known to be required to report anomalies / defects to Port State Control, may well be unwelcome by the ships that otherwise need their services. The UK ADSPA and pilot bodies are discussing with the MCA / port state control, the means by which such anomalies noted are to be reported so that the employment of Deep Sea Pilots is in no way compromised.
