3 3 -Cambodia developed the anti-corruption law in 2010 which has 57 articles -Since 2010, the Royal government of Cambodia has established Anti-Corruption Institution to combat corrupted cases at all both public and private sectors. -There are some institutions which involve in preventing corruptions such as Ministry of Inspection, National Audit Authority and Inspectorate General of ministry of Economy and Finance, Internal Audit and Inspectorate within the Ministry. 1. Overview of Anti-Corruption Mechanism in Cambodia

4 4 2- Anti-Corruption Institution -Anti-corruption mechanism in Cambodia consist of National Anti-Corruption Council and Anti— Corruption Unit -National Anti-corruption Council which consists of 11 figure members from the King’s representative, Senate, National Assembly, Government, National Audit Authority, Ministry of inspection, Human Right Committee, Magistrate, Council of law and justice reform, Council of Lawyer and head of anti- corruption unit

5 5 - Mission of Anti-Corruption Unit is to eliminate corruptions all fields through educating the public, preventing and implementing law to combat the corruptions - Slogan of Anti-corruption: Not want to corrupt, Not able to corrupt and Not dare to corrupt - There are some laws that can implement corruption cases such as criminal code and civil code and other other related law.

6 6 Structural Organization of Anti-Corruption Unit 1-General department of administration and security 2-General department of operation under the two general departments, there are some departments such as: -Department of security -Department of declaration of asset and debt -Department of investigation -Department of lawsuit -Department of education and prevention of corruption -There are approximately 220 staff working at anti- corruption unit

7 7 Function of Anti-corruption unit -Implement existing laws related to corruption cases -Prevent and obstruction corruption cases -Receiving and solve complaints on corruption -Control on the asset declaration of government employees -Has the rights to warn people who in the first stage of failing to complied the law ….

Definition of Anti-Corruption Case There are 42 anti- corruption definitions stated in the anti-corruption as follows: bribe offered to employees, bribe taking by governor, definition of passive business influence, improper bidding, bribe offered to judges, bribe offered to experts, definition of passive business influence, definition of favoritism, active business influence, ……… ………………..

Anti-Corruption Strategy -To date ACI designed Five-Year Strategic Plan (2011-2015) and Three-Year Plan of Action (2011- 2013) -The strategic plan and action plan aimed at 5 areas: -Education -Prevention and obstruction -Law enforcement -National and international cooperation -Good governance management and internal inspection

10 10 Anti-Corruption Strategy 1.Education Area -Raise awareness on Anti-Corruption Law -Disseminate information on corruption to raise awareness and promote to the public in preventing obstruction and fighting corruption -Culture clean mindset and morality to public -Organize National Anti-Corruption day celebration every year on 09 December to entrance and strengthening anti-corruption spirit of the public.

11 11 Anti-Corruption Strategy 2. Prevention and Obstruction -Prevention and obstruction through out public entities by establishing focal point groups -Develop and put in the operation the asset and liabilities declaration system affectively -Improve public service provision process through participating in developing service standard with relevant ministries, institution.

12 12 Anti-Corruption Strategy 3. Suppression Site -Arrange the effective complaint receiving system -Improve effectiveness of investigation and promote offences cracking-down through building capacity- equipping the tools and equipment and necessary skills, building information network providers….

13 13 Anti-Corruption Strategy 4. National and International Cooperation - Promote national and international cooperation through participating in any meetings, workshops, signing MOU with state ministries, institutions, private sectors, local and civil societies.

Good Governance Management and Internal Inspection -Carry out internal inspection (self-investigation and monitoring) -Monitor and investigate plan set out -Strengthening institutional framework o increase operation effectiveness including setting out the guideline for good governance, internal inspection, code of conducts and internal regulation, human resource management policy, capacity development…

Some Results on the Cracking-down of Corruption Cases -Arrest and sentenced some prosecutors and judges who committed illegal acts - Make penalty and sanction on tax officers and custom officers -Arrest corrupted officer of some ministries: ministry of Urban Planning and Land Management, Ministry of Social Affaire ……

16 16 6. Challenges and Conclusions 1. Anti-corruption law is new and ACU has not matured. Big challenges were facing and need to be addresses now are to get to know each other, be aware of law 2. Increase cooperation with stakeholders private sector and publics 3.Continuing to educate and mobilize to stakeholders to joint together for fighting corruption purposes
