4 JACK O’CONNELL State Superintendent of Public Instruction Title III Invoicing The Language Policy and Leadership (LPLO) staff has completed invoicing for any local education agency (LEA) who had unexpended balances for fiscal year (FY) 2007–08 as reported on the End of Year Report (EOY). If your LEA received an invoice and believe it was received in error, please contact the LPLO at 916-319-0845.

5 JACK O’CONNELL State Superintendent of Public Instruction Title III Apportionments The fifth apportionment for FY 2008–09 has been submitted to the School Fiscal Services for processing. Warrants will be mailed to county treasurers in approximately six to eight weeks. The first and second apportionments for FY 2009–10 are in the approval process and should follow shortly after the FY 2008–09 fifth apportionment.

6 JACK O’CONNELL State Superintendent of Public Instruction Expenditure Reporting (Consolidated Application, Part I) The Consolidated Application (ConApp) Part I is due on June 30, 2010. LEAs will report their expenditures for FY 2008–09 and FY 2009–10. Only LEAs that verify that they have expended or encumbered at least 80 percent of previous apportionments will receive the next apportionment.

7 JACK O’CONNELL State Superintendent of Public Instruction 2010-11 Eligibility and Application Process (Limited English Proficient) Applications for 2010–11 must be submitted by June 30, 2010. Applications submitted after this date are not guaranteed funding. LEAs eligible to apply via ConApp I (those with an estimated amount of $10,000 or more Limited English Proficient (LEP) Student Subgrant must check “yes” on page 2.

11 JACK O’CONNELL State Superintendent of Public Instruction 2010-11 Eligibility and Application Process (Immigrant) As a result of the 2009 federal monitoring visit, two items regarding Immigrant funding have changed: (1) the percent growth required for eligibility was lowered from five to two percent; and (2) the threshold amount for direct funded vs. consortia funded also decreased from $10,000 to $5,000.

12 JACK O’CONNELL State Superintendent of Public Instruction 2010-11 Award Letters Apportionment notification letters for the 2010-11 school year must await the signing of the budget. They are anticipated to be mailed to LEAs within a month of the budget signing. Letters confer spending authority for the LEP Student Subgrant Programs and Immigrant Student Subgrant Programs.

13 JACK O’CONNELL State Superintendent of Public Instruction Private Schools (LEP) In previous years the LEAs had to submit to the CDE a paper document with the number of private school English learner (EL) students served with Title III products and services. Beginning with 2010–11, the paper process is now obsolete, and the number of ELs served will be submitted through ConApp I, Page 4.

14 JACK O’CONNELL State Superintendent of Public Instruction Private Schools In previous years private schools had to submit to the CDE a paper document entitled “Request to Participate” which either requested or declined Title III services. Beginning in FY 2010–11, the paper process is now obsolete and the submission will take place online. Letters to private schools and LEAs are anticipated to be mailed mid-May and are due June 30, 2010. Information is anticipated to be posted mid-May at the following Web page: http://cde.ca.gov/fg/fo/r22/imm10rfa.asp

17 JACK O’CONNELL State Superintendent of Public Instruction Title III Year 2 and Year 4 Local Educational Agencies in Improvement Status The Year 2 Improvement Plan Addendum (IPA) and the Year 4 Online Action Plan (OAP) were reviewed on February 2–3, March 24–25 and April 27–28, 2010. Readers from the California Department of Education (CDE), County Offices of Education and the California Comprehensive Center at WestEd.

18 JACK O’CONNELL State Superintendent of Public Instruction Title III Year 2 and Year 4 Local Educational Agencies in Improvement Status Based on this review, the CDE is sending a feedback letter to the LEAs with copy to their Regional County Office of Education Lead.

19 JACK O’CONNELL State Superintendent of Public Instruction Title III Year 2 LEAs and consortia that have failed to meet Title III AMAOs for two consecutive yeas are required to develop an IPA as required by the Elementary and Secondary Education Act, Section 3122(b)(2).

22 JACK O’CONNELL State Superintendent of Public Instruction Title III Year 2 A total of 129 LEAs identified as not meeting the Annual Measurable Achievement Objectives (AMAOs) for two consecutive years based on 2008-09 data. CDE has received and reviewed 124 IPAs.

23 JACK O’CONNELL State Superintendent of Public Instruction Title III Year 2 5 LEAs have not submitted their plans -Bert Corona Charter, LA -Gertz-Ressler Academy High, LA -KIPP LA College Preparatory, LA -Stanford New School, San Mateo -Alpaugh Unified, Tulare CDE sent a letter in May to these LEAs urging them to submit their IPA.

24 JACK O’CONNELL State Superintendent of Public Instruction Title III Year 4 As per 2008-09 data, 9 LEAs were identified as not meeting their AMAOs for four consecutive years. All 9 LEAs have submitted their Online Action Plan and have been reviewed.

34 JACK O’CONNELL State Superintendent of Public Instruction Community-Based English Tutoring Program Pursuant to Senate Bill x3 4 (SB x3 4), Community-Based English Tutoring (CBET) Program funding for 2008-09 through 2012-13 may be used for any educational purpose. All program requirements are suspended during this flexibility period. Funding for 2009-10 through 2012-13 will be based on 2008-09 allocations, rather than on EL counts.

35 JACK O’CONNELL State Superintendent of Public Instruction Community-Based English Tutoring Program In addition to flexibility for 2008-09 through 2012-13 funding, SBx3 4 provides that CBET balances as of June 30, 2008 may be used for other purposes. The time period to do so ends June 30, 2010. The CDE sent a payment request to the State Controller’s Office on November 16, 2009 for 100 percent of the allocation for 2009-10. Funding results for 2009-10 are posted on the CDE Categorical Programs Web page at http://www.cde.ca.gov/fg/aa/ca/cbet.asp

36 JACK O’CONNELL State Superintendent of Public Instruction Community-Based English Tutoring Program The May Revised Budget released on 5/14/10 includes $40,095,000 for CBET for fiscal year 2010-11. Each LEA that received CBET funding for 2008-09 will automatically receive funding for 2010-11, without having to apply for it. For budgeting purposes, each LEA can estimate its allocation for 2010-11 by multiplying its 2008-09 allocation by 0.9476483. This will be its allocation for 2010-11, provided $40,095,000 is appropriated for CBET in the final 2010 State Budget.

38 JACK O’CONNELL State Superintendent of Public Instruction English Language Acquisition Program English Language Acquisition program (ELAP) funding for 2008-09 through 2012-13 has NOT been granted flexibility. ELAP funding must still be used to provide supplemental services to ELs in grades four through eight. However, ELAP balances as of June 30, 2008 may be used for other purposes. The time period to do so ends June 30, 2010.

The CDE sent a payment request to the State Controller’s Office on December 23, 2009 for 100 percent of the allocation for 2009-10. 40 JACK O’CONNELL State Superintendent of Public Instruction English Language Acquisition Program Application forms for 2010-11 were mailed on March 1, 2010. The form is also posted at http://www.cde.ca.gov/fg/fo/r22/elap10rfa.asp The submission deadline was May 1, 2010. However, late applications will be accepted. Late applicants will receive funding, provided sufficient funding is available to meet the statutory minimum of $100 per pupil for all applicants.

41 JACK O’CONNELL State Superintendent of Public Instruction English Language Acquisition Program The May Revised Budget released on 5/14/10 includes $50,376,000 for ELAP for fiscal year 2010-11. For budgeting purposes, each LEA can estimate its allocation for 2010-11 by multiplying its number of English learners in grades four through eight on the CALPADS Fall 1 data collection by $109. With few exceptions, do not include English learners enrolled in charter schools in the student count for funding.

All program requirements are suspended during this flexibility period. Funding for 2009-10 through 2012-13 will be based on 2008-09 allocations, rather than on teacher training provided.

Each COE that received BTTP funding for 2008-09 will automatically receive funding for 2010-11, without having to apply for it. For budgeting purposes, each COE can estimate its allocation for 2010-11 by multiplying its 2008-09 allocation by 0.940851. This will be its allocation for 2010-11, provided $1,702,000 is appropriated for BTTP in the final 2010 State Budget.
