4 JACK O’CONNELL State Superintendent of Public Instruction 4 “Award” Letters Letters regarding funding for the 2010 – 11 school year is anticipated to be mailed out late November. The letters confer spending authority for the Limited English Proficient (LEP) and Immigrant Education Programs, and local educational agencies (LEAs) do not need to wait to receive their apportionment from their county offices in order to begin spending. In future years, LEAs will not receive a letter regarding their allocation amounts. They may access their allocations around mid-November of each year at the Consolidated Application Program Entitlements Web page at http://www.cde.ca.gov/fg/aa/ca/consolapp.asp.

5 JACK O’CONNELL State Superintendent of Public Instruction 5 Allocation Amounts The per-pupil allocation for LEP is $105.75. The total allocation amounts will be available on the Title III Language Instruction for LEP Students Web page at http://www.cde.ca.gov/sp/el/t3/lep.asp in late November. The per-pupil allocation for Immigrant is $105.00. The total allocation amounts will be available on the Title III Immigrant Students Web page at http://www.cde.ca.gov/sp/el/t3/immigrant.asp in late November.

6 JACK O’CONNELL State Superintendent of Public Instruction 6 Apportionments The request for the last apportionment for fiscal year (FY) 2008–09 was submitted to the School Fiscal Services Division (SFSD) in mid-October. The third apportionment for FY 2009–10 was submitted to the SFSD in mid-October. The first apportionment for FY 2010–11 is anticipated to be processed by late November.

7 JACK O’CONNELL State Superintendent of Public Instruction 7 End of Year Expenditure Reports End of Year (EOY) Expenditure reports were due on November 1, 2010, and the window is now closed. If your LEA has not submitted, please contact the Language Policy and Leadership Office (LPLO) immediately. All obligations must be liquidated no later than 90 days after the funding period ends. For the FY 2008–09 sub-grant, all obligations need to be liquidated by December 30, 2010.

8 JACK O’CONNELL State Superintendent of Public Instruction 8 Legal Obligations According to the California State Accounting Manual, “Legal obligations are commitments made by an LEA to purchase goods or services immediately or in a future period.” To determine whether a financial commitment should be reported as an obligation, please refer to Title 34, Part 76, Section 707 from the Code of Federal Regulations (CFR): Retrieve by CFR Citation Web page found at http://www.gpoaccess.gov/cfr/retrieve.html (Outside Source).

9 JACK O’CONNELL State Superintendent of Public Instruction 9 The Student National Origin Report LEAs not submitting a Student National Origin Report (SNOR) in FY 2010 will be receiving a “Late SNOR letter” and will need to submit their SNOR immediately. Non-submission of SNOR data can impact eligibility for Title III Immigrant funding for up to three years.

10 JACK O’CONNELL State Superintendent of Public Instruction 10 The Student National Origin Report LEAs should have submitted SNOR data via California Longitudinal Pupil Achievement Data Systems (CALPADS) on October 6, 2010, and will update SNOR data via CALPADS on March 1, 2011. Private Schools will submit SNOR data to the CDE electronically via the CDE’s SNOR online reporting Web page. The window will open on March 1, 2011. Note: The Private School immigrant count submitted in March, 2011, should reflect the count taken either on October 6, 2010, or March 1, 2011. 11 JACK O’CONNELL State Superintendent of Public Instruction 11 Immigrant Student Definition As of July 1, 2009, the definition of Immigrant Students has been updated. Sections 3301(1) and (6) of the Elementary and Secondary Education Act (ESEA) define immigrant children and youth as individuals who: 1) Are aged three through 21 2) Were not born in any state* 3) Have not been attending one or more schools in any one or more states for more than three full (cumulative) academic years. *Section 3301(14) of the ESEA defines “State” as each of the 50 states, the District of Columbia, and the Commonwealth of Puerto Rico.

15 JACK O’CONNELL State Superintendent of Public Instruction 15 Two-Way Bilingual Immersion LEAs will be receiving a letter requesting information for the Two-Way Bilingual Immersion (TWBI) directory. A form was included with the letter and is to be faxed to Michele Anberg-Espinosa at 916-319-0138 by December 19, 2010, with current information about new or already existing TWBI programs. Schools currently listed on the directory also should have received a copy of the form and should coordinate with their LEA superintendent’s office so that forms are not submitted twice.

20 JACK O’CONNELL State Superintendent of Public Instruction 20 Consequences of Not Meeting the AMAOs If a Title III LEA or consortia does not meet one or more of the AMAOs in any year, it must: Inform the parents of all ELs in the LEA, or consortia as a whole, that the AMAOs have not been met This notification should be provided within 30 days of the public release of the Title III Accountability Reports

Analyze the data and information to discern strengths and weaknesses of the current LEA plan for effectiveness with EL students 3. Formulate responses to address each element of the IPA that needs improvement

63 JACK O’CONNELL State Superintendent of Public Instruction 63 English Language Acquisition Program The English Language Acquisition program (ELAP), with its associated funding ($50M), has been merged into Economic Impact Aid (EIA), beginning with FY 2010-11. While ELAP funds were used to provide supplemental services to ELs in grades four through eight, EIA funds are used to support supplemental services for kindergarten through grade twelve (K–12) ELs and low-income students.

64 JACK O’CONNELL State Superintendent of Public Instruction 64 English Language Acquisition Program Any ELAP funds carried over from FY 2009-10 or prior are to be used according to original ELAP restrictions until spent.
