7 How it came about 1997– new Scottish Parliament – Labour minority McConnell elected First Minister 2002 – Labour coalition with Lib Dems – McLeish elected First Minister 2007 – SNP minority but Alex Salmond elected First Minister 2011 – SNP majority ( not supposed to happen ) - 1 st priority Referendum. 2016 – next election for MSPs – any bets?

11 The Scottish Government Energy responsibilities Scotland Act 1997 & Scotland Act 2012 The Scotland Act 1998 (an Act of the UK Parliament) created a Scottish Parliament and passed to it the powers to make laws on a range of issues. These powers were extended by the Scotland Act 2012 (e.g. drink driving, speed limits and income tax !!). The original devolution made matters of nuclear energy, coal, gas and electricity “reserved matters” upon which only the UK Parliament can make law; exceptions are environmental matters which includes planning issues.

There are however other relevant Acts - amongst which are: Marine (Scotland) Act 2010 ( Scottish Government SG) – implemented Apr. 2011 SG responsibilities for activities in Scottish inshore waters 0 to 12 nm. Marine & Coastal Access Act 2009 (SG) – implemented Apr. 2011 SG responsibilities for licensing and enforcement for offshore waters 0 to 200 nm. Climate Change (Scotland) Act 2009 (SG) SG to cut emissions by 100% by 2020. Coastal Protection Act (SG) Food and Environmental Protection Act (SG)

13 ..and what has happened for example, to the Marine (Scotland) Act? = set up Marine Scotland – Directorate of SG responsible for integrated management of Scotland’s seas www.Scotland.gov.uk/marinescotland 700 staff Controls 61% of UK sea area Substantial support assets ( ships etc!) Commissioned substantial reports across Scottish academia. Budget around £50m + share of research budget £70m.
