2 Labour Amendment Collective Agreement SAFETY POLICY – sect 8 –to develop, in consultation with workers –Foundation of a safety program –Provides for self check and assessment Inspections Safety Audits – every 4 yrs –Material Safety Data Sheet –Joint Workplace Safety & Health Committee

3 Clarity of Definitions & Terms Used Contract of employment –Needs to be in sync with SSB –On-the-job training – SSB requirements Disable person –Needs to be clarify with both SSB as well as how lost time will be recorded Lockout –Term used differently for safety process with a technical implication

4 Probationary Period OSH will require –PPE to be provided –Training as per equipment to be used –Informed of the hazards or hazardous conditions that may exist Orientation –Orientation program to inform of working environment, working conditions, polices, safety requirements etc.

5 Termination & Unfair Dismissal Right to Know Right to Refuse Sect 26 –Assisting an inspector, or gives an inspector info –Complain about Safety and Health conditions –has exercised his or her functions as a safety health committee or is a member of a safely and health committee. Sect 28 –A person shall not, deliberately create a risk, falsely create fear of risk or create the appearance of risk

6 Duty to Provide Drinking H 2 0 & Sanitary Facilities While quantity not stated – NEW structures must comply with the Building Act/Architectural Standards which defines # of facilities to workers – this conflicts with the labour law – need to be address OSH requirement of Healthy and Safety environment –Water supply on all work sites –Sanitary for all sites
