3 The Numbers  Lay-Off FTE is 144  To achieve this FTE, 187 teaching employees had to be laid-off  This number translates to approximately 2 years and 8 months of seniority

4 Rights under Collective Agreement  Right to post into assignment(s) as a D category applicant up to 2011 June 30  Right to rescindment up to 2011 June 30  Recall after 2011 June 30  Severance after 2011 June 30

5 Spring Transfer Process (STP)  Apply for postings as usual but as “D” Category  Access to postings as usual  Complete “Positions Applied For” form  No interview

6 STP (cont’d)  “Interview Committee” chooses most senior qualified candidate  Job offer confirmed through HR  Turn down of offers in this period will not affect recall rights

7 Status On Leave  If you are on Maternity/Parental/Sick leave your layoff is suspended until the end of your Leave period  Your layoff is effective your date of return  You will be considered a “D” candidate for the Post and Fill process for the duration of your leave

8 Qualifications  Paper qualification  Experience qualification  Reasonable expectation for success  Individuals should apply for positions for which they believe they are qualified

9 Qualifications (cont’d)  Qualification adjudication, if disputed, will be determined by the layoff committee.  If layoff committee cannot agree expedited arbitration is possible.

10 Rescindment Rights  Before 2011 June 30, if successful through the posting process, the layoff notice will be rescinded

11 Rescindment Rights (cont’d)  Prior to 2011 June 30, individuals who apply for and accept an FTE lower than their current FTE, will be considered to have reduced their FTE voluntarily and permanently

12 Severance  Severance Pay - 5% per year of salary of continuous service for a full 1.00 FTE  Rounded to the nearest month to a maximum of one year of salary  Pro-rated for less than 1.00 FTE

13 Severance (cont’d)  An individual has the right to collect severance any time for the 28 months following date of layoff  Severance is final! All ties with the VBE are severed  To collect severance, a letter must be sent to HR

14 Recall Rights (after 2011 June 30)  All individuals not receiving rescindment or severance will be placed on a recall list for a period of 28 months from date of layoff  All individuals on the recall list have the right to apply for the TOC list and will be accepted to that list  Individuals may apply for temporary or continuing contracts but at all times maintain their laid off FTE recall right

15 Recall Rights (cont’d)  Turn down of temporary offers will not affect recall rights  Turn down of continuing offers will affect recall rights – a second turn down of a continuing offer will result in the individual losing all recall rights including severance

16 Employment Insurance (EI)  For all laid off continuing contracted teachers, as of 2011 June 30 a Record of Employment (ROE) will be electronically submitted to EI  Teachers who are recalled should be aware that EI funds received may be audited

17 EI (cont’d)  Instructions on “How to Make an EI application via the Web” will be provided to teachers who receive layoff notices  Teachers may apply for EI on their last day of work

18 Benefits  MSP, Extended Health, Dental and Group Life Insurance stay in effect until 2011 August 31  Employees on the recall list may continue benefits with 100% being prepaid by the employee

19 Summer School  Separate from K-12  Has no bearing on the layoff/recall process

20 Summer Posting Period (SPP)  Teacher postings are online at https://myvsb.vsb.bc.ca for VBE employees https://myvsb.vsb.bc.ca  VBE username and password is required to view postings  Please contact Helpdesk to set up your username and password

21 SPP (cont’d)  Tuesday, August 16 – Postings open  Monday, August 22 – Postings close at 4:30 p.m.  August 16-22 – Postings may be viewed  8:30 a.m. – 4:30 p.m. VBE - Room TBA

22 SPP (cont’d)  Apply to temporary or continuing postings as a “D” Category candidate  Awarding of temporary postings does not affect recall status  Individuals MUST complete temporary contracts for which they have applied and been the successful candidate

23 SPP (cont’d)  Individuals who are the successful candidate for a continuing position equivalent to their laid off FTE are deemed to be fully recalled  Individuals who are the successful candidate for a continuing position less than their laid off FTE retain partial recall rights

24 SPP (cont’d)  In all cases individuals on the recall list, when applying for jobs, will not receive interviews  The most senior qualified candidate will be selected by the school “Interview Committee”  Job offers will be confirmed through HR

25 You Have a Temporary Job  Must complete all temporary contracts  Seniority is accumulated but only applied once continuing status has been regained

26 You Have a Temporary Job (cont’d)  Sick Days – banked sick days before 2011 June 30 may be accessed while on temporary contract  Don’t forget that the 28 month recall time period is still in effect

27 You Have Been Fully Recalled  Employees have been restored to full status  Access to all rights under the Collective Agreement including sick days banked and seniority accumulation

28 After 2011 Sept 01  Maintain up-to-date information regarding email and/or home address  Apply for postings as a “D” category candidate through the normal process

29 After 2011 Sept 01 (cont’d)  Recall rights continue as described previously  Remember – THE CLOCK IS STILL RUNNING!!

30 2010-2011 Recall List  If you are currently a “D” category who was laid off last year you maintain all the rights described today, except you have, effective 2011 June 30, 16 months of recall rights remaining  If you have worked in a temporary contract this year, you have not accrued seniority, nor has the clock stopped ticking on your recall

31 4 Reminders  1.Severance means severed  2.If you are on the recall list you must apply for the TOC list – IT IS NOT AUTOMATIC

32 4 Reminders (cont’d)  3.TOC on scale days will count for seniority if and when continuing status is regained  4.Recall is an active process – YOU MUST APPLY FOR JOBS
