4 YOUNG CHILDREN’S LEGAL RIGHTS TO SERVICES Healthcare - Early and Periodic Screening and Treatment  Children covered by Medicaid have a right to: “early and periodic screening, diagnostic, and treatment services” which include medical or remedial services... “for the maximum reduction of physical or mental disability and restoration of an individual to the best possible functional level.”  42 U.S.C. § 1396d(a)(4); 42 U.S.C. § 1396d(a)(13)

6 YOUNG CHILDREN’S LEGAL RIGHTS TO SERVICES Early Intervention For Children With Disabilities  Part C of the Individuals with Disabilities Education Act (IDEA) is a federal grant program that entitles all children under age 3 with disabilities to identification and services.  20 U.S.C. § 1400  The Child Abuse Prevention and Treatment Act (CAPTA) requires each state to have “provisions and procedures for referral of a child under the age of 3 who is involved in a substantiated case of child abuse or neglect to early intervention services funded under Part C of the Individuals with Disabilities Education Act”  42 U.S.C. § 5106a
