Participants: –“Shall inform the IEEE (or cause the IEEE to be informed)” of the identity of each “holder of any potential Essential Patent Claims of which they are personally aware” if the claims are owned or controlled by the participant or the entity the participant is from, employed by, or otherwise represents — “Personal awareness” means that the participant “is personally aware that the holder may have a potential Essential Patent Claim,” even if the participant is not personally aware of the specific patents or patent claims –“Should inform the IEEE (or cause the IEEE to be informed)” of the identity of “any other holders of such potential Essential Patent Claims” (that is, third parties that are not affiliated with the participant, with the participant’s employer, or with anyone else that the participant is from or otherwise represents) –The above does not apply if the patent claim is already the subject of an Accepted Letter of Assurance that applies to the proposed standard(s) under consideration by this group Early identification of holders of potential Essential Patent Claims is strongly encouraged; there is no duty to perform a patent search

6 doc.: IEEE 802.11-10/0355r0 Submission Mar 2010 Andrew Myles, CiscoSlide 6 The JTC1 ad hoc will operate using general guidelines for IEEE WG Meetings All IEEE-SA standards meetings shall be conducted in compliance with all applicable laws, including antitrust and competition laws. –Don’t discuss the interpretation, validity, or essentiality of patents/patent claims. –Don’t discuss specific license rates, terms, or conditions. — Relative costs, including licensing costs of essential patent claims, of different technical approaches may be discussed in standards development meetings. — Technical considerations remain primary focus –Don’t discuss or engage in the fixing of product prices, allocation of customers, or division of sales markets. –Don’t discuss the status or substance of ongoing or threatened litigation. –Don’t be silent if inappropriate topics are discussed … do formally object. See IEEE-SA Standards Board Operations Manual, clause 5.3.10 and “Promoting Competition and Innovation: What You Need to Know about the IEEE Standards Association's Antitrust and Competition Policy” for more details.

Individuals are to address the “technical” content of the subject under consideration and refrain from making “personal” comments to or about the presenter.

14 doc.: IEEE 802.11-10/0355r0 Submission Mar 2010 Andrew Myles, CiscoSlide 14 The 802.11 WG has agreed with SC6 to liaise Sponsor Ballot drafts to SC as a matter of course The 802.11 WG proposed that it liaise every Sponsor Ballot draft to SC6 for review and comment as a matter of course SC6 indicated this was desirable in a liaison –… SC6 would welcome the opportunity to receive as a matter of course new draft text at the start of every Sponsor Ballot or Sponsor Ballot recirculation of developing IEEE 802.11 work for circulation to its National Bodies. By this means SC6 National Bodies will have the opportunity to provide review and comment through liaison back to IEEE 802.11 –See liaison from SC6 If any comments are received it is likely the Chair of the relevant TG will insert them into MyBallot suitably annotated, e.g., “Submitted on behalf of ISO JTC1 from ”

15 doc.: IEEE 802.11-10/0355r0 Submission Mar 2010 Andrew Myles, CiscoSlide 15 The 802.11 WG has liaised four Sponsor Ballot drafts to ISO/IEC JTC1/SC6 since Jan 2010 In recent times a number of drafts have been sent to SC6 –802.11v D9.0 on 4 Feb –802.11u D8.0 on 22 Feb –802.11p D10.0 on 21 Feb –802.11z D7.0 on 21 Feb The drafts were announced to the SC6 membership on 25 Feb, which highlights an issue between differences between typical IEEE and ISO timescales No comments have (yet) been received

16 doc.: IEEE 802.11-10/0355r0 Submission Mar 2010 Andrew Myles, CiscoSlide 16 802.11 WG sent a liaison to JTC1/SC6 in Nov 09 in relation to its intended use of the PSDO process In November 2009 the WG sent a liaison (11-09-1273r1) that –Documents recent and planned future activities in the IEEE 802.11 WG –Flags an intention to submit various documents using the PDSO process –Offers JTC1 and SC6 NBs the opportunity to submit comments into the SB process The liaison has been received and is posted in the ISO/IEC JTC1/SC6 document directory It was discussed at the SC6 meeting in Jan 10 but no reply was sent to the IEEE 820.11 WG

17 doc.: IEEE 802.11-10/0355r0 Submission Mar 2010 Andrew Myles, CiscoSlide 17 It was recognised in Hawaii in Sept 09 that WAPI is the main JTC1/SC6 related issue of interest It was agreed in Hawaii in Sept 09 that WAPI remains an important and constant issue for consideration This is the case for a variety of reasons, possibly including: –WAPI appears to duplicate functionality of 802.11i –The promoters of WAPI assert that 802.11i is insecure — Albeit without any apparent published evidence –It is unclear how or whether 802.11i and WAPI can coexist –…

18 doc.: IEEE 802.11-10/0355r0 Submission Mar 2010 Andrew Myles, CiscoSlide 18 The new project proposal for WAPI in ISO/IEC JTC1/SC6 was approved WAPI was submitted by the China to ISO/IEC JTC1/SC6 as a New Project proposal for a stand alone standard IEEE 802 submitted a liaison to SC6 in Nov 09 in relation to the justification of the project –See 11-09-1254r1 This liaison was discussed at the SC6 meeting in Jan 10 but no reply was received The SC6 National Bodies subsequently approved the New Project –10/18 NB’s votes “yes” (10 required) –5 NB’s stated they would participate in the project (5 required) It is not known when the new project activities will start

19 doc.: IEEE 802.11-10/0355r0 Submission Mar 2010 Andrew Myles, CiscoSlide 19 The IEEE may have an ongoing interest in the WAPI project The IEEE staff are still considering issues in the WAPI draft related to copyright The 802.11 WG may have an opportunity to review drafts from the new project for compatibility with 802.11 and for security The 802.11 WG will need to consider WAPI when considering when a how to submit further amendments to ISO/IEC JTC1 as part of the 8802- 11 series The 802.11 WG may want to inform SC6 that the current draft of WAPI uses an IE identifier that conflicts with an IE identifier already allocated to 802.11k …

20 doc.: IEEE 802.11-10/0355r0 Submission Mar 2010 Andrew Myles, CiscoSlide 20 Update on plans for a tutorial in Beijing in May 2010 on the Chinese standards development process At the meeting in Jan 10 the JTC1 ad hoc and the 802.11 WG agreed: –The JTC1 ad hoc recommends to the 802.11 WG that appropriate Chinese standards groups be invited by the 802.11 WG Chair to present a tutorial on the Chinese standards processes related to LAN/MAN/PAN networking technologies, in a slot in which IEEE 802 also describes its processes. This tutorial would be held sometime on Monday to Wednesday at the meeting in Beijing in May 2010 Bruce Kraemer has been discussing the possibility of a tutorial with various stakeholders –Bruce may provide an update
