7 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods Legal framework In accordance with the current Law – unsafe toys are those toys which composition or other properties may adversely affect the health of children. Aforementioned rulebook stipulates general and special conditions for trade of toys. General conditions apply to materials, design, composition toys. Toys can be made ​​only with: - materials that do not contain ingredients harmful to health; - materials without mechanical pollution - materials that can be maintained hygienically (washed).

8 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods GENERAL CONDITIONS FOR TRADE Hairs from toys and dolls must not fall off when shaking, combing, pulling out, Toys for infants can be made only from materials that can be disinfected or boiled, in such way that toys at the same time do not change the quality. These toys must be designed so that children cannot swallow it and put it in their nose or ear.

9 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods General conditions for trade In terms of construction toys: - must not be pointed or with sharp or jagged edges - must be made with smooth surfaces, - electrical voltage in toys that are powered with electricity must not be higher than 24 V.

10 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods GENERAL CONDITIONS FOR TRADE The colors used for coloring the toys must not transfer from toys to the saliva and shall not contain more than defined concentration: arsenic, lead, cadmium, mercury, barium, chromium, antimony and selenium calculated on 1 kg of dry paint. Toys are not allowed to be painted with pigments based on cadmium, mercury, selenium, lead, arsenic and chromate or with 4-dimethylaminoazobenzene

11 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods GENERAL CONDITIONS FOR TRADE Organic dye may not relase more than: - 0,1 mg/kg carcinogenic polycyclic aromatic hydrocarbons, naphthalymine, benzidine or 4-aminodyphenil. Dyes for toys are not to be removed from toys during use, washing or sanitizing and must be odorless.

12 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods Special conditions for trade - for making metal toys it must not be used lead or zinc or alloys containing more than 1% of lead (it is not applicable for models of cars – toys), and for soldering metal toys tin alloy that contains more than 10% of lead must not be used, - toys made from artificial masses can be made only from polymers that are not harmful to health, - for toy production it can be used not easily flammable celluloid,

13 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods Special conditions for trade Production of toys out of textile prohibits using textile that is processed with agents that may have an adverse effects on health. Skin and fur must be sterilized before use. It is prohibited production of toys out of glass, porcelain, ceramic or clay. Toys made of wax or similar materials that are used for modeling must not contain solvents or softeners harmful to health or ingredients that are releasing paint.

14 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods Special conditions for trade It is prohibited use of pyrotechnical materials for toy production that could hurt children during the game. It is prohibited use of mercury rhodanide in toy production. Toy that are placed in mouth during the game and infant toys must be packed in special and closed packaging. Mechanical quality of toys made of rubber or artificial masses filled with air (soccer balls, animal figures, swimming belts, etc.) during production and trade could be checked with pneumatic machine intended for this purpose

15 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods INSTITUTIONAL FRAMEWORK Ministry of health Adoption of legislation in the field of toy safety is under the competence of the Ministry of Health Inspection Directorate Sanitary inspectors are carrying out inspection surveillance for toys and also inspectors for electronic communication (EMC). Sanitary inspectors are doing surveillance during import and trade. Surveillance of toy safety on the market is carried out ​​in accordance with the Plan of market surveillance.

16 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods INSTITUTIONAL FRAMEWORK Toy testing in Montenegro is carried out by two laboratories: Institute for public health in Podgorica (physical and chemical), Center for ecotoxicological research in Podgorica (physical and chemical tests, radioactivity).

17 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods HARMONISATION Existing legislation from this area is not harmonised with relevant EU regulations. Based on the Law on Technical Requirements for Products and Conformity Assessment ("Official Journal of Montenegro", No. 53/11), it is planned to adopt regulation on the safety of toys harmonised with the Directive on the safety of toys 2009/48EZ.

18 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Chapter 1: Free movement of goods HARMONISATION The Ministry of Health began preparations for the harmonization of national legislation on toys safety with EU legislation. Harmonization of legislation has been recognized as necessary to enable the free circulation of toys safety that are safe, as well as effective supervision to protect of children health.
