In 2001, a survey of young people in Southend showed that 47 per cent had tried an illegal drug at some point in their lives! Q2. 20. Drugs and the Law On January 2003 cannabis was reclassified as a Class C drug This means that the maximum penalty for possession will be two years' imprisonment. However, supply will still remain at 14 years (maximum). Also, possession in and around any educational establishment or near any gathering of young people e.g. youth clubs etc will result in an automatic prosecution. On other occasions, a police officer may use their discretion regarding the amount for "personal use". If caught, the person will receive a caution (which will be recorded) and have their supply of cannabis confiscated. However, this is a "once only" opportunity! If caught again, the person will be prosecuted.
