2 CEN WORKSHOP on Anti-Counterfeiting About CEN CEN, the European Committee for Standardization, was founded in 1961 by the national standards bodies in the European Economic Community and EFTA countries. Now CEN is contributing to the objectives of the European Union and European Economic Area with voluntary technical standards which promote free trade, the safety of workers and consumers, interoperability of networks, environmental protection, exploitation of research and development programmes, and public procurement. CEN is a non-profit making technical organization set up under Belgian law.

3 CEN WORKSHOP on Anti-Counterfeiting About CEN workshop CEN Workshop Agreements (CWAs) are consensus-based specifications, drawn up in an open Workshop environment.

4 CEN WORKSHOP on Anti-Counterfeiting Basic premises: For Health & safety reasons product counterfeiting is a crime and deserves commensurate penalties Penalties can only be given to the guilty Therefore it is necessary to  Detect fakes  Prove the forgery and use forgeries  Prove that the defendant produced/distributed/sold those fakes

5 CEN WORKSHOP on Anti-Counterfeiting COUNTERFEITING CRIME A new approach on anti-counterfeiting and anti-trafficking against counterfeit goods

6 CEN WORKSHOP on Anti-Counterfeiting Technical demonstration of proof is one of the best shortcuts in the fight against counterfeiting-crime

7 CEN WORKSHOP on Anti-Counterfeiting From Track and Trace to Secure Trail The proposed CEN workshop can make a contribution by establishing the protocols and definitions for detection and proof of fakes (physical authentication) and perpetrator to these fakes (serialization & tracking or Secure Trail)

8 CEN WORKSHOP on Anti-Counterfeiting These anti-counterfeiting strategies must cover the means of detection of fakes; This detection requires communication between Right holders & authentication providers on the one hand and examiners on the other; The content of that communication depends on which category of examiner it is addressed to; The different types of authentication are appropriated to different categories of examiners; And communication between different types of authentication suppliers is also essential

9 CEN WORKSHOP on Anti-Counterfeiting Examiners, for example: Who they are and what are the categories What each category can be expected to examine With what tools or equipment What communications between Right holders and them

10 CEN WORKSHOP on Anti-Counterfeiting Define Technology Categories: Physical features Secure Trail features Relationship with one of these technologies: Verify the product Verify the packaging Verify it is in the right place Verify the code Relationship to examiners &… Definitions & Function of authentication layers

11 CEN WORKSHOP on Anti-Counterfeiting Statement of which technology/ies operate for which category of examiner Expanded flow-chart of detection procedure for professional examiners: –Relationship of secure tracking code to authentication device –Examination methods –Online/offline –Naked eye, assisted eye, assay, internet, etc Communications

12 CEN WORKSHOP on Anti-Counterfeiting In accordance with the Council of Europe Convention of April 2007, as follows: Performing counterfeiting presumption for enforcement and seizure Performing prosecution against counterfeiting- crime These two fundamental issues are subject to the work of and discussion with the workshop participants

13 CEN WORKSHOP on Anti-Counterfeiting IN ACCORDANCE WITH NASPO AND ISO CWA will contribute to the harmonization of anti-counterfeiting technical tools performing seizures and sentences
