8 BACKGROUND Institutional repositories are being created in HEIs Using Open Archives Initiative’s Protocol for Metadata Harvesting-to disclose and harvest metadata about those resources Main barriers not technical, but legal and cultural This model raises a wide range of IPR issues First concern of institutions when setting up an IR?

9 IPR ISSUES Academics sign away right to self archive through CTA’s Article self archived? Are rights asserted e.g. named as author, alterations How ensure other rights given by copyright law Rights issues for Data Providers (DPs) Rights issues for Service Providers (SPs)

10 THE SELF- ARCHIVING PROCESS Academic writes a paper Academic self-archives preprint Academic sends to publisher Publisher referees and accepts Academic self-archives postprint Repository (DP) creates metadata Service (SP) harvests metadata End-user access paper

11 BIGGEST HINDRANCE TO SELF ARCHIVING Academics must publish in refereed journals Journals require authors to sign © Transfer Agreements © Transfer Agreements inhibit self- archiving in a number of ways

12 ALTERNATIVES Choose journals with non-exclusive licences Choose journals with SA-friendly licenses 50% -65% journals allow self archiving 30% give no rights at all Negotiate with your publisher Amend the existing licence Use an alternative licence

26 DP DISCLOSES METADATA Are there rights in a metadata records Yes. © in each record and database rights in a collection If so, who owns them? DP’s and depositors Do DPs think there are rights in metadata? No Do DPs wish to protect their metadata Yes How?

27 SP HARVESTS METADATA Do they check if they can harvest metadata? Do they enhance metadata If so, do they think there are rights in the enhancements? Do they want to protect those rights? How?

28 HOW DOES THIS OUR WORK? Change in roles Do your homework!! What are the purpose for getting copyright clearance? Course reserves, electronic reserves, course packs, other? Licenses for e-resources, does your institution have access, what license has been negotiated? This part can cause the unnecessary expenditures Others…..
