Challenge/Opportunity Supporting institutional objectives/goals while complying with the DMCA and copyright infringement activities. The Wall Street Journal on July 12, 2007 featured an article about how music pirating (the most popular downloads) is being used by radio stations to create playlists. –http://online.wsj.com/public/article/SB1184204439456 64247- wb1k_eabHrAV3eYNaT0_7VZRFhE_20080711.htmlhttp://online.wsj.com/public/article/SB1184204439456 64247- wb1k_eabHrAV3eYNaT0_7VZRFhE_20080711.html

Handling the RIAA Met with Recording Industry Association of America: –Top 25 in number infringement notices –Pressuring the institution to install technology Hardware/Software$500K Authentication System$300K Installation/Maintenance$200K $1 Million

Risks (if we do nothing) Negative Public Relations Increased legislation –Reactive vs. Proactive Increased costs

Assumptions We are receiving a significant amount of DMCA notices (to be in the top 25), but no subpoenas to date. Finite Resources which would require Reprioritization. By putting some device “inline” we increase our liability from a passive conduit to an active conduit. We want to be a role model.

Recommendations Education program for the entire institution. (Developed and implementation Fall 08) Explore other options with University constituents (e.g. campus fora, engage key stakeholders (general counsel)). (Fall 07) Development of policies and processes for response to DMCA notices, pre-litigation letters, subpoenas, etc. (Fall 08) Bandwidth policies (i.e. shaping, control, constraints). (Fall 08)

Recommendations (cont.) Provide legal alternatives. (Fall 08) Explore hardware alternatives (i.e. Audible Magic) in collaboration and communication with the Faculty Senate and Student Association(s). (Fall 07)

Questions and Discussion
