1 Principles of the U.S. Constitution Part 1 FEDERALISM

2 Topic/Objective: To identify one of the seven principles of the U.S. Constitution. Essential Question: How does the Constitution set up a system of government that shares power between the state and federal levels?

3 *U.S. Constitution 1)The U.S. Constitution is the “supreme law of the land” 2)Establishes the framework for running the gov’t

4 *Federalism 1) Def’n - A system of government that shares power between all levels of government:  National  State  County  City  Tribal

5 *Federalism 2) Some powers are delegated to the national gov’t and some are reserved for the states 3) States have their own laws, courts, constitutions, and elected officials 4) The Framers used federalism to structure the Constitution.

6 *Federalism 5) The 10th Amendment to the Constitution allows for Federalism.  "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

7 Division of Powers:  Enumerated Powers (national)  Reserved Powers (state)  Concurrent Powers (nat’l & state) *Division of Powers

8 1) Enumerated Powers: Powers given to the nat’l gov’t to run the country  regulating trade  conducting foreign relations  coin and print money  declare war  Establish a postal system *Division of Powers

9 2) Reserved Powers: Powers not expressly given to the national government; Granted by the 10 th Amendment; Powers used by the states to run more local matters  setting up local governments  establishing schools  marriage and divorce laws  holding elections  regulating in-state businesses *Division of Powers

10 3) Concurrent Powers: Powers shared by both the nat’l & state gov’ts:  levy taxes  borrow money to run gov’t  setting up courts  making & enforcing laws *Division of Powers
