2 What was the Constitutional issue? The constitutional issue for this court case was the students ability of having freedom of speech.

3 Litigant 1: Hazelwood school district H Had a problem with what the students were putting on the school news paper. Thought articles on teen pregnancy were inappropriate because of it’s dealings with students and sexual activities

4 Litigant 2: Kuhlmeier Cathy Kuhlmeier and two other students were in charge of the news paper They were against what the principal decision to cancel the paper and decided to take the school district to court.

5 Background of case The students were making a special issue for there news paper and there were two articles in this issue that the principal didn’t approve of. One was on teen pregnancy and the other was on children dealing with their parent’s divorce. The principal thought these two articles were inappropriate for students in school. Cathy Kuhlmeier and a few other students had a problem with the decision and decide to sue the school.

6 Majority opinion The majority decided that the rights of a student is not the same as adults in other settings and stated a decision on an earlier case “ Bethel School District v. Fraser” that a student’s first amendment right vary depending on the type of expression involved.

7 Other courts opinions The minority opinion was that the principal’s actions on the newspaper was a violation to the student’s first amendment and not just the first amendment but their promise to students that vowed not to restrict free expression or diverse viewpoints within the rules of responsible journalism.

8 Significance The decision in the court was 5 to 3 for Hazelwood school district S Schools are to be able to set high standards for disseminated under their auspices, and that schools retained the right to refuse to sponsor speech that was inconsistent with the shared values of a civilized social order.

9 Your response on this case/reflection I think that school students should be limited by what the schools on what they can say on the newspaper because there are limits to what should be put on paper by students.
