2 Attorney is another name for a Lawyer. There are more than 1 million lawyers in the United States –More than 70% have their own private practice –10% are government lawyers who work for federal, state, or local government agencies

3 –10% work for corporations, unions, or trade associations –The rest work for public interest or legal aid organizations; and a smaller number of lawyers are professors, judges, or elected officials

4 Contrary to popular belief most lawyers…. Most lawyers rarely go to court. Most law practice involves giving advice, drafting (writing) legal opinions, negotiating settlements, or providing out-of-court legal assistance. Trial Attorney (litigator): name for lawyers who go to court

5 When do you need a Lawyer? (page 64) –Buying or selling a home or other real estate –Organizing a business –Changing your family status (for example, by divorce or adoption).

10 Advertisement of lawyers… Lawyers have not always been allowed to advertise. For years, it was considered improper and was forbidden by bar associations and courts In 1977, the Supreme Court ruled that advertising by lawyers was protected by the First Amendment freedom of speech clause

11 Those who support lawyers advertising say… –It helps consumers decide which lawyer to hire –Advertising lowers legal fees through competition

12 Those against advertising by lawyers say… –It encourages lawyers to be salespersons who are likely to made exaggerated claims –Lawyers should not be hired through advertisements but through competence of the lawyer and the lawyer’s skill

13 How do lawyers advertise? –Telephone directories –Newspapers –Radio –Television –Internet –ADVERTISING HAS ENABLED LARGE, LOWER-COST LAW FIRMS, OFTEN CALLED LEGAL CLININCS, TO DEVELOP AND SOME HAVE SPREAD NATIONWIDE

14 Hiring a lawyer can be expensive… –Legal aid programs in some places provide free legal service to low-income people for certain civil cases. –Because of the cost of lawyers, many people are representing themselves by using online materials, how-to books, and phone consultations with lawyers

15 Retainer: a down payment on the total fee. In addition, attorneys may charge clients for court costs, filing fees, or other expenses. Contingency fee: a percentage of whatever amount the client wins or settles for in the case. Usually 1/3 of amount awarded to the client.

16 Another thing to consider before choosing a lawyer is whether your legal issue is one that might be of interest to an advocacy organization or public interest law firm. –These firms and organizations may provide free representation – civil rights violations.
