California Environmental Quality Act (CEQA) Suit Advantages Significant chance to achieve some changes in the project Potential for court ordered mitigations measures Realist possibility to correct several EIR deficiencies Requires parties to look at alternatives A chance to recover attorney fees and costs First opportunity to be heard in neutral forum (s) by Public exercising it’s legal options Disadvantages County attitude towards VOTMA may be impacted Legal fees and costs from $50K to $100K Could lose case and investment. More public hearings possible Community’s commitment to develop Administrative Record
