3 Drafting Principles Establish a better and common understanding of how EU Environmental law could be designed and implemented in a smarter way >>> this could serve as a guide for MS and EU institutions MiW Drafting principles may take different forms Discussions require considerable input (expertise from lawyers, policy makers and practioners) and engagement from MS/EC (and buy-in on importance of a subject) – a challenge

5 Meetings Conferences: Brussels (April 2014); London (February 2015); Edinburgh (December 2015) –Sharing MS experience –Learn about EU level developments –Add wider discussions, e.g. with academic community Workshops: –Compliance assurance: Lisbon (October 2014) (Brussels follow-up) –Monitoring and reporting: Brussels (November 2015)

6 Value and challenges Compliance assurance shows MS can proactively contribute to better EU law making and implementation MiW has lots of discussion between MS and with EC Conferences have an increasing wider interaction – academic community, NGOs, IMPEL, etc. Positioning of MiW - need for shared understanding Need to extend dialogue, broaden support, use deliverables of MiW effectively

7 Future work on Drafting Principles Reporting will still require some considerable work - also need to keep track of new developments Compliance assurance may need to be reviewed in light of new developments Potentially useful to look at access to information, access to justice, permitting Aim is to develop a concrete practical document - the compliance assurance and reporting drafting principles will look different – so new areas could be different again

8 Possible new area of work: coherence issues Analysis of interactions between directives of different areas: –Establish typology of interactions –What are common key problems/challenges –Explore possible practical/structural solutions –Lessons for designing EU law
